20. <br /> <br />2I. <br /> <br />c~ntract for payment. <br /> <br />Reimbursement to Cit?. The DEVELOPER agrees to reimburse the CITY <br />f'.a~ryall co. sts incurred by the CITY in defense or enforcement of this Agreement, o,r <br /> pornon thereof, including court costs and reasonable engineering and attorney s <br />f~es. <br /> <br />Notification. The DEVELOPER agrees to notify the CITY of all sales of lots <br />~thin the Plat. <br /> <br />22. <br /> <br />23. <br /> <br />C ~rtificate of Occupancy. The term "Certificate of Occupancy" as used in this <br />Agmement shall be defined as a document issued by the City's Building Official <br />~ aich authorizes the structure to be used for its intended purposes. <br /> <br />]Marketable Title. Pr/or to recording of the final plat, the DEVELOPER shall <br />provide to the CITY proof of marketable title to both the Plat either through a <br />ctrrently certified abstract, registered property abstract or rifle insurance. <br /> <br />day of. <br /> <br />24. Proof of Authority. When the DEVELOPER is a corporation, the CITY <br /> reqquires proof of authority by the corporation to execute this Agreement. This <br /> prpof of authority could be satisfied by providing the CITY with a certified copy of <br /> m!nutes of the corporate Board of Directors granting such authority. <br /> <br /> 25. IrWaliditv of Any One Section. If any portion, section, subsection, sentence, <br /> clause, paragraph 0r phase of this Agreement is for any reason held to be invalid by <br /> a Court of competent jurisdiction, such decision shall not effect or void any of the <br /> o~er provisions of this Agreement. <br />26. R.~c0rcling of Deveior~ment A?reement. The DEVELOPER agrees that this <br /> D~velopment Agreement shall be recordedTin the office of the Anoka County <br /> Rqcorder and agrees that the terms and provisions of this Agreement shall be a <br /> covenant on any and all deeds reladve to the property included in the Plat. <br /> <br />27. Vi.~)lation Of this Agreement, The DEVELOPER agrees that the terms of the <br /> finhncial guarantee shall be deemed to have been violated if the DEVELOPER <br /> fails to perform any of the terms of this Agreement in the manner required by the <br /> CIrI'Y and the CITY shall be entitled to recover from the DEVELOPER or the <br /> isstler of DEVELOPERS' letter of credit, the full amount of the letter of credit. <br /> <br />28. A~'eement Bindine On Heirs, etc, The DEVELOPER agrees that this <br /> D~,elopment Agreement shall be binding upon their successors and assigns. <br /> Brc~ach of any of the terms of this Development Agreement by the DEVELOPER <br /> sha~l be grounds for denial of Building Permits for buildings in the Plat. <br />IN WITNESS THEREOF, the parries have hereunto set their hands and seals, this ~ <br /> <br />NORTH FORK., INC..
