official, Shall prepare a bill and mail it to the owner and <br />~hereupon th~ amount shall be immediately due and payable at the <br />office of City Administrator. <br /> <br />SECTION 9. ~AS~SHM~NT. <br /> <br /> On or befor9 September 1 of each year, the City A~ministrator shall <br /> list the t~tal unpaid charges for each type of current service <br /> against eac~ separate lot or parcel to which they are attributable <br /> under this !ordinance. After notice and hearing as provided in <br /> Minnesota S~atutes Section 429.061, the Council may then spread the <br /> charges against property benefited as a special assessment under <br /> Minnesota Statutes, Section 429.101 and other pertinent statutes <br /> for certification to the County Auditor and collection along with <br /> current tax~s the following year or in annual installments, not <br /> exceeding t~n, as the Council may determine in each case. <br /> <br /> SECTION 10.~ PENALTY. <br /> <br />Any person ~ho maintains a nuisance in violation of Section 2 or <br />3 and any ~erson who interferes with a city employee or other <br />authorized ~erson in the performance of any current service under <br />this ordinance is guilty of a misdemeanor, but a prosecution shall <br />be brought ~or such violation only on the direction of the Council. <br />If convicte~ of such violation, such person shall be subject to a <br />fine of notimore than $700.00 or imprisonment for not more than 90 <br />days, and t~.'e cost of prosecution in either case may be added. <br /> <br />SECTION 11. i SEPARABILITY. <br /> <br />In case any~section of this ordinance is held invalid by a court <br />of competen~ jurisdiction, the invalidity shall extend only to the <br />section affected and other sections of the ordinance shall continue <br />in full force and effect. <br /> <br />SECTION 12. iEFFECTIV~ DATE <br /> <br />This ordinahce shall become effective thirty (30) days after its <br />passage andlpublication. <br /> <br />PASSED by the City Council this <br />1994. <br /> <br />ATTEST: <br /> <br />day of , <br /> <br />Mayor <br /> <br />City AdminiStrator <br /> <br />Introduction date:Qc~ober 25, 1994 <br />Posting dates: <br />Adoption da~e: <br />Publication date: <br />Effective d~te: <br /> <br /> <br />
