8.4 Time Shares Prohibited.. The timeshare form of ownership, or any comparable <br />form of lease, occupancy rights or ownership which has the effect of dividing the ownership or <br />occupancy of a Unit into separate time periods or ownership intervals is prohibited. <br />8.5 Compliance with Law. No use shall be made of the Property which would <br />violate any then existing municipal codes or ordinances, or state or federal laws, nor shall any <br />act or use be permitted which could cause waste to the Property, cause a material increase in <br />insurance rates on the Property, or otherwise cause any unusual liability, health or safety risk, <br />or expense, for the Master Association. <br />SECTION 9 <br />ARCHITECTURAL AND LANDSCAPE STANDARDS <br />9.1 Standards, The Architectural Review Committee ("ARC") may, in its <br />discretion, impose standards for design, appearance, construction, or development which may <br />be greater or more stringent than standards prescribed in applicable building, zoning, or other <br />governmental laws, codes, or regulations; provided that such standards shall be consistent with <br />the architectural character of the Development Area. It is the intent of Master Declarant to <br />create a general plan and uniform scheme of development of the Property and to create within <br />the Property a community of high quality and harmonious Improvements. Accordingly, an <br />Architectural Review Committee (the "ARC") shall be established as a permanent committee <br />of the Master Association, to oversee, review and regulate all architectural and design matters <br />involving the Property. The ARC shall have the following general powers: <br />9.1.1 The ARC shall have the exclusive right to approve or disapprove the <br />size, exterior design, color, materials, landscaping and location with respect to all <br />proposed Improvements, as well as the general plan for development of all <br />Neighborhoods. <br />9.1,2 The ARC shall have the exclusive right to approve or disapprove all <br />proposed additions, changes and any other type of remodeling to the exterior of any <br />existing Dwelling, Nonresidential Building or other Improvement; except for any <br />changes made by Master Declarant. <br />9.1.3 The ARC may, in its sole discretion, impose standards for design, <br />appearance, construction or development which may be greater or more stringent than <br />standards prescribed in applicable building, zoning or other governmental laws, codes <br />or regulations; provided that such standards shall be consistent with the architectural <br />character and use of the.
