Commissioner Johnson stated that they could include in the conditional use permit thi <br />second dwelling cannot be used as a rental property. <br />Motion by Commissioner Johnson, seconded by Commissioner Reeve, to recomm en ,,that City <br />Council adopt Findings of Fact in the positive relating to Mr. and Mrs. U as req for a <br />conditional use permit to maintain two dwellings on one parcel, includa findings act <br />stating "That the applicants have stated that they will only use the secon ,titling for a re1a V:,, <br />who has health issues" and having finding of fact #9 read "will not". <br />Motion Carried. Voting Yes: Commissioners Johnson, Re -;`and i}ciscak. Voting No: <br />Chairperson Nixt. Absent: Commissioners Griffiths and W 2 a: <br />Motion by Commissioner Johnson, seconded by Cox,e"ioner Kocisto recommend that <br />City Council approve Mr. and Mrs. Upton's reques '"ram nditiona ti brmit based on the <br />findings of fact including the language that the applicant wil n y sd "e second dwelling for a <br />relative. <br />Further discussion: Community Development Director Frolik stated' a , based on discussions <br />that staff has had with the City Attorney heyyhave been told that the City µa of restrict use of <br />the second dwelling to family ni rnbers: nr iissioner Reeve stated t e did not think they <br />need to restrict the use to family:mein ie>rs, but prevent dwelling from being used as a revenue <br />generating rental property.
