Councilmember Elvig introduced the following resolution and moved for its adoption: <br />RESOLUTION #11 -10 -196 <br />A RESOLUTION ABATING THE 2008 SPECIAL ASSESSMENT (2009 Taxes Payable) <br />CHARGE OF $14,642.94 ON PID #35- 32 -25 -31 -0018 <br />WHEREAS, in 2008 the city levied $14,608.89 for the abatement clean up at 6203 <br />Rivlyn Avenue; and <br />WHEREAS, property owner, Keith Kiefer took the city to court over abatement process <br />and assessment; and <br />WHEREAS, Anoka County Court awarded in favor of Keith Kiefer in 2011 due to lack <br />of detail in violation letter; and <br />WHEREAS, the City needs to grant an abatement of the 2008 special assessment charge <br />in the amount of $14,642.94 (principal) plus applicable penalties & interest 23 to PID #35- 32 -25- <br />31 -0018. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, to hereby abate the 2008 <br />special assessment charge in the amount of $14,642.94 and applicable penalties and interest <br />for PID #35- 32 -25 -31 -0018. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Wise, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Ramsey <br />Councilmember Elvig <br />Councilmember Wise <br />Councilmember Backous <br />Councilmember McGlone <br />Councilmember Strommen <br />Councilmember Tossey <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />and the following were absent: <br />None <br />Whereupon said resolution was declared duly passed and adopted by the Ramsey City Council <br />this the 25th day of October, 2011. <br />
