14. <br /> <br />Street CleanSing. After the street surfacing is installed, the DEVELOPER shall clear any <br />soil, earth, or'r debris from the streets within the Plat resulting from any construction within <br />the Plat by the DEVELOPER or its successors and assigns. From time to time, the CITY <br />may remove accumulations of soil, earth and debris from the streets resulting from the <br />construction 9f the Plat. It shall be the DEVELOPER'S responsibility to pay the costs <br />associated with this necessary street cleaning. Invoices from the CITY to the DEVELOPER <br />for such costs',, shall be paid within fifteen (15) days of the date of invoice. <br /> <br />15. <br /> <br /> SECTION III <br /> PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in the <br />Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the <br />structure; (b) a Certificate of Survey, including that survey information required by the <br />CITY has been supplied to the City Building Official, including verification that the building <br />elevation is at least two (2) feet above, the 100 year flood elevation; (c) all the financial <br />guarantees required by the CITY have been satisfied; and (d) the City has been provided with <br />a copy of the :Lower Rum River Water Management Permit. The CITY reserves the right to <br />suspend all building activities upon the CITY being notified by an. outside agency that the <br />appropriate permit(s) was not obtained from the applicable agency. Approval of the building <br />foundation requires a certificate of elevation signed by a licensed (State of Minnesota), <br />professional rand surveyor, verifying that the elevation complies with the approved grading <br />plan for the Plat. No occupancy permit for any lot in the Plat shall be issued until: (a) <br />vehicular access to the lot is provided including the installation of at least one layer of <br />bituminous surfacing; (b) all utilities are in place, operational and accepted by the CITY; <br />and (c) bouleyard sod and landscape trees, or escrow for same, have been provided; (d) for <br />lots that havea slope of less than 2%, a certificate of grading, prepared by a licensed (State of <br />Minnesota), professional land surveyor, must be provided to the City documenting that the <br />flattest grade on the lot is 1% or greater. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />16. Cash, Land, and Park Improvements. The'Plat is located in the Oak Recreation District. <br /> Park dedication requirements shall be satisfied by a cash payment in the amount of Eighty <br /> One Thousan~d Dollars and no cents ($81,000.00) (45 x $1,800.00). The three (3) existing <br /> homesteads are exempt from this fee. This payment shall be made to the City prior to the <br /> release of the Final Plat for recording. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />17. Park Trail Development and Fees. The City Council has established a trail development fee <br /> in the amount of Four Hundred Seventy Five Dollars and no cents ($475.00) per lot.
