CASE <br /> <br />REVIEW T~RMS OF VARIANCE GRANTED TO MR. JAMES McCHESNEY <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you may recall, on September 7, 1993, the Board of Adjustment granted Mr. James <br />McChesney a variance to construct an accessory structure nearer the front property line than the <br />principal structur~ at 15429 Sunfish Lake Blvd. N.W. During the discussion of the variance, there <br />was some disput~ as to the location of the common property line between Mr. McChesney and his <br />neighbor to the s~uth. Consequently, the Board also granted a 5 foot variance to the 10 foot side <br />yard setback on the south property line. <br /> <br />Observations: <br /> <br />Upon having tho property surveyed, it has been determined that one comer of the accessory <br />structure will be ~.5 feet from the side property line and the other comer is 3 feet from the side <br />property line. In Bccordance with the instructions of the Board of Adjustment, Mr. McChesney is <br />coming back for .~irection as to how to proceed when the 5 foot side yard variance is not sufficient <br />to address the st~cture location. Normally, it would not be a problem to relocate a proposed <br />structure but in t~s case, the accessory structure is a rebuild of a former structure and consequently <br />a substantial arnou~ nt of framing is already in place. <br /> <br />CiW Staff is brining this issue before the Planning Commission for some discussion and direction <br />at this time because it is not known when the Board of Adjustment will be meeting again. Mr. <br />McChesney would like some idea of what he has to do in order to construct the building this <br />spring.
