CounciLmcmbca' introduccd thc following resolution and moved for its adoption: RESOLUTION g94-04- A RESOLUTIq)N ADOPTING FINDING OF FACT ~ RELATING TO A REQUEST FROM SIDNEY NYHUSMOEN FOR A CONDITIONAL USE PERMIT TO MINE AND EXPORTS SOILS WHERE~kS: the City of Ramsey received an application from Sidney Nyhusmoen for a conditional use p ~rrnit to mine and export soils from the property legally described as follows: [ Lot 1, Block 1, HY- 10 RAMSEY 4TH ADDITION, Anoka County, Minnesota. (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RA~MSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of facl~ relating to the request are determined to be as follows: That on March 15, 1994, Sidney Nyhusmoen, herein after referred to as "Applicant", has properly a~plied for a conditional use permit to mine and export soils in the I-1 Industrial District That the applicant appeared before the Ramsey Planning and Zoning Commission for a public he .a)'ing pursuant to Section 9.03.04 of the City Code on April 5, 1994, and that said public he~k,-ing was properly advertised and that the minutes of said public hearing are hereby in°°rpomted as a pan of these findings by reference. That the s ~ubject property is located in the Industrial Disu-ict, and is approximately 4.4 acres in size. That minipg is not a permitted use in the Industrial District. That the Subject Property is surrounded by Industrial zoning. That the Applicant is proposing to strip the topsoil on the Subject Property, export approximately 17,430 cubic yards of mater/al, and replace the topsoil. That no fill materials are proposed to be imported to the site. 9. 10. 11. 12. That no blasting will be employed in the mining activity. [ That no excavation will take place within the road right-of-way. That the e~tisting drainage patterns will not be substantially altered by the proposed grading plan. :., That there are other similar conditional use permits that have been approved by the City. That the mining operation willJwill not increase the ~affic to the subject property and surrounding area. 13. That the Proposed use will/will not be unduly dangerous or otherwise detrimental to persons reaiding or working in the vicinity of the use or to the public welfare.
