Councilmember ~ <br /> <br />introduced the following resolution and moved for its adoption: <br />RESOLUTION NO. 94.04- <br /> <br />A RESOLUTION DECLARING TERMS OF CONDITIONAL USE PERMIT, <br />BASED ON FI[NDINGS OF FACT NO~ , FOR MINING OPERATIONS <br />ON PIN NO. ~29.32-25-11-0009. <br /> <br /> WHERE~S, the Ramsey City Council adopted Resolution No. 94-04- regarding <br />Findings of Fact I~.o. ___ for this use and herein approves the Conditional Use Permit subject <br />to the following ctbnditions. <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ~kNOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On , 1~94, a Conditional Use Permit ("CUP") was issued by the City of Ramsey <br />("City") to Sidne~ Nyhusmoen ("Permit Holder") for mining operations on the property legally <br />described as follows: <br /> <br />Lot 1, BloCk 1, HY-10 RAMSEY 4TH ADDITION, Anoka County, Minnesota. <br /> <br />This permit is isshed pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. <br />conditions of this [~ermit are as follows: <br /> <br />1. This permi,~ shall expire on May 1, 1997. <br /> <br />The <br /> <br />All equiprpent used for mining operations shall be maintained and operated in such a <br />manner to O:2nimize noise, dust, and vibrations adversely affecting surround/ng properties. <br />All equipment shall be kept in good repair. Abandoned equipment and rubbish shall be <br />removed frbm the worksite regularly. ,. <br /> <br />All worksites shall be properly safeguarded to prevent the general public from depositing <br />garbage or [other refuse on the worksite. <br /> <br />Existing n'te and groundcover shall be preserved to the extent feasible. <br /> <br />Mining op~,rations shall be conducted in such a manner to minimize interference with the <br />surface wa~er drainage outside the boundaries of the operation. <br /> <br />No mining ~Operations shall occur at below an elevation of 6 feet above the elevation of the <br />water table On the worksite. <br /> <br />Fencing m~ be ordered by the City Council or City Engineer anytime the permit is in force <br />and shall b~ installed within 24 hours of written notice. <br /> <br />All access loads from the mining operation to the. public su'eets shall be maintained in order <br />to minimize dust- ":: <br /> <br />The maximpm slope other than the working face shall be, sloped on ail sides no steeper than <br />a rate of 2 foot horizontal to 1 foot vertical. In no case Shall the slope of the working face <br />be left unattended with a slope greater than 2 feet horizontal to 1 foot vertical. When <br />mining op4rations are anticipated to be discontinued for an interval greater than one <br />working day, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 <br />foot vertical. <br /> <br /> <br />
