Councilmember ~ introduced the following resolution and moved for its adoption: RESOLUTION NO. 94.04- A RESOLUTION DECLARING TERMS OF CONDITIONAL USE PERMIT, BASED ON FI[NDINGS OF FACT NO~ , FOR MINING OPERATIONS ON PIN NO. ~29.32-25-11-0009. WHERE~S, the Ramsey City Council adopted Resolution No. 94-04- regarding Findings of Fact I~.o. ___ for this use and herein approves the Conditional Use Permit subject to the following ctbnditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ~kNOKA COUNTY, STATE OF MINNESOTA, as follows: On , 1~94, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to Sidne~ Nyhusmoen ("Permit Holder") for mining operations on the property legally described as follows: Lot 1, BloCk 1, HY-10 RAMSEY 4TH ADDITION, Anoka County, Minnesota. This permit is isshed pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. conditions of this [~ermit are as follows: 1. This permi,~ shall expire on May 1, 1997. The All equiprpent used for mining operations shall be maintained and operated in such a manner to O:2nimize noise, dust, and vibrations adversely affecting surround/ng properties. All equipment shall be kept in good repair. Abandoned equipment and rubbish shall be removed frbm the worksite regularly. ,. All worksites shall be properly safeguarded to prevent the general public from depositing garbage or [other refuse on the worksite. Existing n'te and groundcover shall be preserved to the extent feasible. Mining op~,rations shall be conducted in such a manner to minimize interference with the surface wa~er drainage outside the boundaries of the operation. No mining ~Operations shall occur at below an elevation of 6 feet above the elevation of the water table On the worksite. Fencing m~ be ordered by the City Council or City Engineer anytime the permit is in force and shall b~ installed within 24 hours of written notice. All access loads from the mining operation to the. public su'eets shall be maintained in order to minimize dust- ":: The maximpm slope other than the working face shall be, sloped on ail sides no steeper than a rate of 2 foot horizontal to 1 foot vertical. In no case Shall the slope of the working face be left unattended with a slope greater than 2 feet horizontal to 1 foot vertical. When mining op4rations are anticipated to be discontinued for an interval greater than one working day, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 foot vertical.
