Councilmember ~ <br /> <br />introduced the following resolution and moved for its adoption: <br />RESOLUTION g94-04- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT $$ ' RELATING TO A <br />REQUEST FQR A CONDITIONAL USE PERMIT TO ~ffl~'-AND AN OUTDOOR <br />RECREATIONAL FACILITY IN THE INDUSTRIAL DISTRICT <br /> [. <br /> <br /> WHERI~AS, KRS investments, dba Smiley's, hereinafter referred to as "Applicant", has <br />properly appliec~, for a Conditional Use Permit to expand the outdoor recreational facility in an <br />Industrial DistriCt to include batting cages on the property generally known as 14622 Ferret St. <br />N.W. and legally~ described as follows: <br /> Lot 2, BlOCk 1, HY-10 RAMSEY, Anoka County, ML~nesota <br /> <br />CITY <br />1. <br /> <br />(the "Subject Property") <br />NOW T[-IEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the ~pplicant appeared before the Planning Commission for a public hearing pursuant <br />to Sectiofl 9.03.04 (Conditional Use Permits) of the Ramsey City Code on April 5, 1994 <br />and that said public hearing was properly advertised and that the minutes of said public <br />hearing ye hereby incorporated as a pan of these findings by reference. <br /> <br />That the iubject property is zoned Industrial and is approximately 4.2 acres in size. <br /> <br />That the a/:tjacent properties to the north and west are also zoned Industrial and the adjacent <br />property ~o the east and the property on the south side of Hwy. #10 N.W. is zoned B-3 <br />H_ighwayi Business. ~- <br /> <br />That on April 26, 1988, the City Council issued a conditional use permit to the Subject <br />Property ~or the establishment of an outdoor recreational facility in the Industrial District <br />that would include miniature golf, go-cart track, bumper boats and roller rink. <br /> <br />That the Applicant is proposing to expand the outdoor recreational use by the addition of <br />batting cages. <br /> <br />9. <br /> <br /> 13. <br /> <br />That the Applicant has submitted a copy of the original site plan for the facility which <br />indicates an area for batting cages that will not encroach on the 69 off-street parking spaces. <br /> <br />That the Applicant has stated that they will fulfill the commitments of the prior property <br />owners a/ad install required site improvements to the off-street parking area (bituminous <br />surfacing land concrete curbing) over the next 2 year period. <br /> <br />That access to the recreational facility will contiiaue,to be from Ferret St. N.W. <br /> <br />That the proposed use Mil/will not increase traffic to 'and from the subject property. <br /> <br />That the propostd use will/will not be unduly dangerous or otherwise detrimental to <br />existing o~ future neighboring uses. <br /> <br />14.
