Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #94-05- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A HOME OCCUPATION <br />ON THE PROPERTY GENERALLY KNOWN AS 14794 KRYPTON COURT <br />N.W. <br /> <br /> WHEREAS, Diane Dempsey, hereinafter referred to as "Applicant", has properly applied <br />for a Conditional Use Permit for a home Occupation to conduct doll-making classes on the <br />property generally known as 14794 Krypton Court N.W. and legally described as follows: <br /> <br />Lot 5, Block 3, WOOD POND HILLS 3RD ADDITION; Anoka County, State of <br />Minnesota. <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.04 (Conditional Use Permits) and Section 9.11.04 (Home <br />Occupations) of the Ramsey City Code on May 3, 1994 and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br /> <br />That the Applicant's dwelling is the initial home to be developed on Krypton Court N.W. <br />and therefore all affected property owners will not have had the opportunity to comment on <br />the request for a conditional use permit for a home occupation because at the time of the <br />public hearing mailing, ownership of all surronding parcels is retained by the developer of <br />Wood Pond Hills. <br /> <br />That the subject property is zoned R-1 Urban Residential and is approximately 13,000 <br />square feet in size. <br /> <br />4. That commercial activties are not a permitted use in the R-1 Urban Residential District. <br /> <br />5. That the subject property is surrounded by R-1 Urban Residential zoning. <br /> <br />That the Applicant has provided documentation to support that the home occupation will be <br />conducted within the private dwelling on the property and that the area set aside for the <br />home occupation does not exceed 20% of the total floor area of the private dwelling. <br /> <br />That the Applicant will reside at the location of the prdPosed home occupation. <br /> <br />That the Applicant has stated that the home occupation will not include any employment of <br />persons not res/ding in the private dwelling in the performance of the home occupation. <br /> <br />That the Applicant has stated that there will be no exterior storage of business equipment <br />and materials. <br /> <br /> <br />
