*Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #94-07- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />PERMIT FOR AN ACCESSORY APARTMENT IN A SINGLE FAMILY <br />STRUCTURE IN THE R-1 RURAL RESIDENTIAL <br /> <br /> WHEREAS, Rebecca Jackson has properly applied for a conditional use permit <br />("Permit") to maintain an accessoD' apartment within the single family dwelling in the R-1 Rural <br />Residential Dismct on the property generally known as 15823 Nowthen Blvd. N.W. and legal}), <br />described as follows: <br /> <br />Lot 4, Block 8, WHISPERING PINES ESTATES PLAT 3, Anoka Count),, Minnesota <br /> <br /> ~THEREAS, the Planning Commission met on July 5, 1994, conducted the public <br />hearing and recommended 0i~ Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact # , a conditional use permit (the "Permit") for an accessoD, <br />apm'unent within the single farn/ly dwelling unit is hereby granted to Rebecca Jackson, (the <br />"Permit Holder"), at 15720 Kangaroo Street N.W. (the "Subject Property"). <br /> <br />That said Perm/t shall remain in effect so long as the conditions imposed herein are <br />complied with and the property owner maintains residence in one of the two units on the <br />Subject PropenT. <br /> <br />3. That the structure exterior shall maintain the appearance of a single family dwelling unit. <br /> <br />That the structure shall not be further altered to render it marketable as a duplex or the <br />accessory apartment as a condominium. <br /> <br />That the accessor-;,.' apartment shall be restricted to a one (1) bedroom unit and is approved <br />for occupancy by a maximum of two (2) persons. <br /> <br />"Friar ail occupants of the dwelling and accessou, apartment shall be prov/ded with off-street <br />parking. <br /> <br />That the Permit Holder herein agrees to absolve the City from any and all obligation <br />associated with the issuance of this conditional use permit as a result of the intensified use <br />of the property. <br /> <br />That the Permit Holder herein agrees to accept all responsibility for maintaining the <br />accessory apa.rrrnent in accordance with applicable buikhng and fire codes. <br /> <br />That the Permit Holder and/or property owner shall be responsible for all City costs <br />incurred in administering and enforcing this Permit. <br /> <br />10. <br /> <br />That the City Adminisn'ator, or his/her designee, shall have the r/ght to inspect the premises <br />for compliance and safe~, purposes annually or at any r/me, upon reasonable request. <br /> <br />The motion for the adopdon of the foregoing resolution was duly seconded by Councilmember <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> <br />
