property ~described in paragraph 1 of this description; thence northerly along the easterly <br />line of ~ajd property forty (40) feet; thence southeasterly and parallel w~th said Highway 1~) <br />to the eas~t~; eriy line of said Lot Three (3): thence souther}y on said easterly line to the point <br />of beginaing. <br /> <br /> NiOW TItEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF TL~E CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />10. <br /> <br />]2. <br /> <br />That the Applicant appeared before the Planning and Zoning Commission for a <br />p~blic hearing pursuant to Section 9.03.04 of the Ramsey City Code on July 5, <br />1~94 and that said public hearing was properly advertised and that the minutes of <br />s~id public hearing are hereby incorporated by reference. <br /> <br />That the subject property is located in the B-3 Highway Business District and is <br />alSproximately 4 acres in size. <br /> <br />T~hat the Applicant is proposing to place a 12' x 54' (648 square foot) portable <br />office structure on the subject property. <br /> <br />That the Applicant has stated that the purpose of the temporary structure is to <br />pr~vide office space on the subject property until the fire damage to the pnncipal <br />b~ilding that occurred on June 14, 1994 is repaired. <br /> <br />That utilization of ternpora.D.., structures is not a permitted use in any zone in the CiD, <br />of Ramsey without a special permit. <br /> <br />That the Applicant has stated that the tempora_%, structure will ~ kept on the subject <br />p(Operty for approximately 6 months to al. iow sufficient time to reconstruct the <br />pr'j.ncipal building. <br /> <br />That the properties to the south~ west and east are also zoned B-3 Highway; the <br />prpperry on the north side of the Burlington Northern railroad tracks is zoned <br />B0siness Warehous. <br /> <br />That the pror>osed temporaD' structure has already been located on the sire and the <br />Albplicant ha's deposited a $500.00 financial guarantee with the CiB' to ensure timely <br />removal of the structure in the event the permit application is denied or upon the <br />e~P/.ra6on date of the permit. <br /> <br />That the proposed temporary structure will not increase traffic to or from the subject <br />prCperty because it is not an enlargement of the faciliry but rather a tempora.ry <br />replacement of existing office space lost in the f'~re. <br /> <br />That the proposed temporary structure will/will not be unduly dangerous or <br />d~'mmental to persons residing or working in the area. <br /> <br />Ttia~ the proposed temporary su-ucture will/will not impair the use of surrounding <br />properties. <br /> <br />That the proposed temporary structure w/II/will not be maintained so as to be <br />appropriate in appearance with the character of the general area. <br /> <br /> <br />
