CASE <br /> <br />REQUEST FOR SKETCH PLAN APPROVAL OF GUY ADDITION, A MINOR <br />SUBDIVISION; CASE OF NEIL GUY TRUST <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Ellion Knetsch, representing the Nell Guy Trust, has applied for a minor subdivision to plat the <br />Guy property on,Hwy. #10 into 4 commercial lots. <br /> <br />Observations: <br /> <br />All of the lots m~et the minimum size and dimension requirements for the B-3 I-Lighway Business <br />Dis~ct. <br /> <br />The major conqern with this plat are the two accesses onto Hwy. #10. The review and <br />recommendat_ion¢ of Mn/DOT have been solicited and any plat approval should be contingent upon <br />compliance with I¢ose recommendations. City Staff is also recommending that a 60 foot drainage <br />and utility easement be dedicated along the northern boundary of the plat for future development as <br />a service~road in Ce event Mn/DOT purchases access rights ~)nto Hwy. #10. <br /> <br />An adddfional concern is the easternmost building which is only one foot from the common <br />property line w£~th the parcel ro the east. This is a non-conforming situation and Staff is <br />recommending t~jt no variance to the side yard setback be granted with the plat. The result of this <br />action is that if t~e building ever goes vacant for six consecutive months or if it is damaged in an <br />amount equal to for exceeding 50% of its market value, it may not be re-used or reconstructed <br />unless it is brougl~t up to code. <br /> <br />Park dedication Will consist of a cash payment. <br /> <br />The following items are enclosed for your information: <br /> <br /> a) Sire location map <br /> b) Proposed subdivision <br /> c) site plan indicating location of existing buildings <br /> d) Ci{)' Stuff review letter dared June 29, 1994 <br /> <br />RecommendatiOn: <br /> <br />C/ty Staff recomr/bends approval of the subdivision contingent upon compliance with C/ty Staff <br />review letter and MMDOT recommendations for accesses onto Hwy. #10. <br /> <br /> Commission Action: <br /> <br />Motion to: <br />Recommer~d that City Council grant final plat approval to Gu',, Addition contingent upon <br />compiianc~ with City Staff review letter dated June 29, 199'4 and recommendations of <br />Mn/DOT. <br /> <br />Review Chec 'kJdst: <br />PC: <br /> <br />Cib, Engineer <br />715f94 <br /> <br /> <br />
