8.71.02 Definitions <br /> <br />Accessory Apartment means a separate complete housekeeping unit that is substantially <br />contained within the structure of a single family unit, but can be isolated from it. The <br />existence of separate cooking facilities shall distinguish an accessory apartment fi.om taking <br />in boarders or roommates. <br /> <br />8.71.03 Fees and Application Procedures <br /> <br />A. Application for an accessory apartment permit shall include the following: <br /> <br />1. Accessory apartment application form. <br /> <br />Site plan showing property dimensions and all existing buildings on the site <br />and their dimensions. The site plan shall also include the dimensions of the <br />off-street parking area and garage to support off-street parking require- <br />ments. <br /> <br />3. Floor plan, existing and proposed, with dimensions specified. <br /> <br />4. Facade drawings. Indicate any exterior alterations proposed. <br /> <br />5. Affidavit of residency and ownership. <br /> <br />Upon the request for an accessory apartment permit being officially submitted, a <br />public hearing before the Planning Commission shall be scheduled following <br />proper hearing notification. The notice shall be published in the official newspaper <br />at least ten (10) days prior to the hearing, and written notification of said hearing <br />shall be mailed, at least ten (10) days prior, to all parcel owners within 350 feet of <br />the boundary of the parcel for which an accessory apartment permit is being sought. <br />A copy of the notice and a list of the property owners shall be made a part of the <br />record of the proceedings. For the purpose of written notification and in the <br />absence of more accurate information, the parcel owner of record at the Anoka <br />County Assessors Office shall be used. Failure of a property owner to receive the <br />notice shall not invalidate any such proceedings as set forth within this section, <br />provided a good faith attempt has been made to comply with the notice requirements <br />of this section. <br /> <br />The Planning Commission shall conduct the public hearing, make a Findings of <br />Fact, and recommend to the City Council such actions or conditions relating to the <br />request as it deems necessary to carry out the intent and purpose of this Chapter. <br /> <br />Do <br /> <br />The City Council shall not consider a request for an accessory apartment permit <br />until it has received a recommendation from the Planning Commission or until 60 <br />days after the adjournment of the Planning Commission public hearing at which the <br />request was considered. <br /> <br />Upon receiving the recommendation of the Planning Commission, the City Council <br />shall have the option to set and hold an additional public hearing if it deems <br />necessary. <br /> <br /> <br />
