REVIEW POLICY OF ALLOWING NON-INTOXICATING <br /> ALCOHOLIC BEVERAGES IN CITY PARKS <br /> By: Mark Boos, Parks/Utilities Coordinator <br /> <br />Background: <br /> <br />Case #1 <br /> <br />For several ycamCity Council has granted a temporary permit to allow non-intoxicating alcoholic <br />beverages at Cefltral Park for the community picnic. The .review of this policy is before the <br />Commission to provide an opportunity to comment on the issue. <br /> <br />It is expected that thc Ramscy Lions Club, the primary sponsor of the community picnic, will <br />request a sales permit in late spring of this year. <br /> <br />Observations: <br /> <br />It is believed that the primary policy issue at hand is whether the City's condoning this element of <br />the picnic conflicis with other ideals, most notably D.A.R.E. (Drug Abuse Resistance Education). <br />It should be funh~:r noted that Staff is unaware of any complaints related to the provision of non- <br />intoxicating mal~ liquors, or charges of being antonymous, but the possibility of a perceived <br />conflict has been pointed out. <br /> <br />Approximately one year ago, City Staff collected our neighboring CityIs ordinances relating to this <br />issue. The City of Anoka states in their City Code 24-2H "Gambling, excessive use of alcoholic <br />beverages, and aiJusive, boisterous, profane or indecent language, conduct, or attire is prohibited <br />in public parks. No alcoholic beverages shall be possessed or consumed in the parks where notice <br />of such restriction is posted." The City of Andover states in Ordinance 47 Section 2 <br />"Consumption or possession of alcoholic beverages is not allowed in City parks unless a permit is <br />obtained under S~tion 2.3A .... An exclusive use permit may be approved by the City Council <br />and issued by the ~ity Ci,e, rk for the selling of food and alcoholic or non-alcoholic beverages as set <br />forth by City ResOlution. The City of Coon Rapids in Chapter 10-416 Section 1 and 2 states "No <br />person shall brings, have in his possession, or consume alcoholic beverages at any time in any park <br />except as provided in Sub-section 2." Sub-section 2 reads "Consumption of non-intoxicating <br />alcoholic beverages is perm/ned in parks if purchased from a person licensed to sell in such park <br />pursuant to the prOvisions of City Code 5-209. All sales shall be individual drinks and shall be <br />served for consumption on the licensed premises." <br /> <br />The above then acknowledges that allowing these beverages at picnics seem to be the norm. <br /> <br />Attached for your information: <br /> <br />A) <br />B) <br />C) <br />D) <br /> <br />The City of Ramsey's City Code relating to non-intoxicating malt liquors <br />The City _O_,ode chapter relating to park use <br />The City of Ramsey Facility Use Permit <br />The City of Ramsey Tournament/Event Facility Use Application <br /> <br />Somewhat related [to this discussion would be our tournament and park-use permitting. It has been <br />City policy to disallow any alcoholic beverages in City parks. It is possible that if it was the City's <br />desire to actively~encourage tournaments as a revenue source, that allowing non-intoxicating <br />alcoholic beverages could make it more profitable for sponsors of tournaments and, therefore, <br />garner more activity for the City. <br /> <br />Commission Action: <br /> <br />Based upon discussion. <br /> <br />Reviewed by: <br />City Administmtori <br />Parks/Utilities Coordinator <br />P&R: 2/10/94 <br /> <br />Copies also distributed to: <br />Police Chief <br />Public Work Supervisor <br /> <br /> <br />
