Mr. Jankowski once again explained the process of selecting the alignment in order to dispel Mr.
Deemer's conspiracy theory.

Mr. Deemer stated he believed the conspiracy was not on the part of Mr. Jankowski, but that one
exists.

Commissioner Terry stated that the lots are viable with what is in the record at the present time.

Commissioner Holland inquired as to whether Mr. Jankowski's information as to what is being
proposed is considered in the record.

Mr. Jankowski stated it should be.

Acting Chairperson Hendriksen again stated he didn't believe the road alignment recommended by
the Planning Commission was fairly presented to City Council, however, if the green line becomes
City Council's choice, then the sketch plan is moot because it will be out of alignment.

Commissioner Terry communicated, however, that the sketch plan is viable from what is officially
on the maps. He added that if the City does something to make the sketch plan no longer viable,
then the City is responsible for compensation.

Mr. Deemer also noted that if the city proceeds with the current alignment, that his wells are in the
right-of-way.

Motion by Commissioner Terry and seconded by Commissioner Holland to approve the sketch
plan for ~unview First Addition based upon the existing sketch plan of Chestnut Hills and that
sketch plan of record coming through, and contingent upon the extension of sewer and water
through Chestnut Hills.

Motion carded. Voting Yes: Acting Chairperson Hendrikse.n, Commissioners Terry, Holland,
Deemer, and Thorud. Voting No: None. Absent: Chairperson Bawden and Commissioner
LaDue.

Commissioner Terry stated for the record that the motion he made is based upon facts in front of
the Commission (the plat of Chestnut Hills and a viable sketch plan) and not on conjecture of
future plans.

Case #6: Reschedule June, 1994 Meeting Date

Motion by Commissioner Deemer and seconded by Commissioner Holland to reschedule the June,
1994 meeting date to Monday, June 6, 1994.

Motion carried. Voting Yes: Acting Chairperson Hendriksen, Commissioners Deemer, Holland,
Terry, and Thomd. Voting No: None. Absent: Chairperson Bawden and Commissioner LaDue.

Case 87: Monthly Status Report

This information was noted by the Planning Commission.

Case #8: Zoning Bulletin and Zoning News

Commissioner Deemer directed Staff to retain the April, 1994 issue of Zoning News to use in
consideration of the architectural review ordinance.

Planning & Zoning Commission/May 3, 1994
