! <br />! <br /> <br /> NORTHFORK PUD <br /> <br />ADDENDUM TO PARK DEDICATION AGREEMENT <br /> <br /> ADDENDUM to Park Dedication Agreement, hereinafter "ADDENDUM", <br />made this ~/~- day of May, 1989, by and between North Fork, Inc., <br />hereinafter "DEVELOPER"; and the City of Ramsey, Anoka County, <br />State of Minnesota, hereinafter "CITY". <br /> <br /> 1. WHEREAS, CITY and DEVELOPER have entered into a certair <br />P~rk Dedication Agreement, hereinafter "AGREEMENT", dated February <br />19, 1987, and attached hereto as Exhibit "A" and incorporated <br />herein; and <br /> <br /> 2. WltEREAS, Paragraph 6 of the AGREEMENT reserved the <br />determination of Park Dedication requirements for that portion of <br />the Northfork PUD located southerly of 153rd Avenue N.W., <br />hereinafter "future phase"; and <br /> <br /> 3. WHEREAS, the future phase consists of approximately 137 <br />acres; and <br /> <br /> 4. WHEREAS, the City Code generally permits the CITY to <br />require 10% of the acreage of any plat to be dedicated for park <br />purposes; and <br /> <br /> 5. WHEREAS, the CITY has indicated its desire to take park <br />dedication for the future phase in land; and <br /> <br /> 6. WHEREAS, since the execution of the' AGREEMENT the CITY <br />has identified certain specific public"park use needs which can <br />best be satisfied by the dedication of land located in areas of the <br />Northfork PUD other than the future phase and DEVELOPER is willing <br />to dedicate such alternate land as partial satisfaction of park <br /> <br /> <br />
