9. Builders and contractors shall comply with the Tree Protection Plan <br />including all protection zones of specimen or significant trees. Builders shall post tree <br />protection plan along side the building permit. <br /> <br />V. Required Escrows and Planting Compensation <br />As compensation for trees cut during development and construction, the developer and <br />contractor/builder shall comply with one of the following two options. <br /> <br />A. Cash Payments <br /> 1. The developer shall be required to escrow an amount per lot to be <br />determined by the CiD' Staff based on quantity and quality of significant and specimen trees <br />to be protected. The escrow shall be released only after all developer, contractor, and <br />builder construction is complete. <br /> <br /> 2. In addition, the developer shall contribute to the City Reforestation Fund an <br />amount per acre to be determined by the City Staff based on the quantity and quality of <br />significant and specimen trees scheduled in the tree protection plan to be removed by any <br />part of the developer's construction. The amount required shall not exceed $__ <br /> <br /> 3. The developer shall be required to replace any tree within the tree protection <br />zones which dies or is damaged as a result of any development related disturbance. If trees <br />cannot be immediately replaced, the developer shall escrow $200 per tree before any <br />building permit shall be issued. In addition, the developer shall remove any dead trees. <br /> <br /> 4. The builder or contractor shall be required to replace any tree within the tree <br />protection zones which dies or is damaged as a result of an), site related construction. If <br />conditions do not allow immediate tree replacement, the builder shall escrow $200 per tree <br />before the Certificate of Occupancy will be issued. <br /> <br /> 5. Any trees required to be planted shall be replaced if the3' die or appear to be <br />in decline within one (1) year of planting by the person'fe"sponsible for the planting. In <br />addition, the responsible pant shall remove the declining or dead tree. <br /> <br /> 6. Any required tree planting shall be a minimum of two-and-one-half (2 1/2") <br />inches in diameter if deciduous or five (5') feet in height if coniferous per nursery standard <br />measurements. Tree replacements shall be varied in species, shall prefer the use of species <br />native to the Anoka Sand Plain, Big Woods, and Savanna regions of Minnesota, and shall <br />comply with current city staff, consultant and DNR District Forester species <br />recommendations. The trees shall be planted in close proximity to the lost trees unless <br />otherwise specified by City Staff. <br /> <br />-OR- <br /> <br />B. Replantings <br /> 1. If any si~ificant tree in development or building site is cut, damaged or the <br />area within the tree's drip Iine has been encroached upon, by grading equipment without <br />City authorization but the tree(s) in question will probably survive (as diagnosed by the <br />City Forester/Tree Inspector) the builder/developer shall he"required to plant two (2) new <br />trees with a minimum diameter of two-and-one-half (2 1/2") inches for deciduous trees; or <br />five (5') feet in height for coniferous trees. <br /> <br /> 2. If any significant tree(s) die or will probably not survive (as diagnosed by <br />the City Forester/Tree Inspector) as a result of being cut, damaged, or encroached upon <br />through development, the City shall require compensation planting of tree(s) equal to 50% <br /> <br /> <br />
