Subd. 3. Billing Statements <br /> <br />Billing sta~ments for street lighting charges for the preceding period shall be mailed to each <br />customer and shall be deemed sufficient notice to the customer of charges made. Said <br />statements ~;hall be due and payable by the date indicated on the specific billing statement. <br /> <br />Subd. 4. Delinquent Account <br /> <br />All billingistatements not paid on or before the due date shall be considered delinquent <br />accounts. It. shall be the duty of the City to promptly collect delinquent accounts, and the <br />customer ~hall be duly notified or, in the case the customer cannot be found, then the <br />person in charge of the premises. <br /> <br />Subd. 5. Service Charges <br /> <br />An3, amouats due hereunder plus interest and penalty may be collected in an action brought <br />for that pu~ose in the name of the City; or the Clerk may certify to the County Auditor the <br />amount dug for street lighting charges plus interest and penalty, together with the legal <br />descriptiod of the premises served and the County Auditor shall thereupon enter such <br />amount within the tax levy on said premises collectible with the taxes for the ensuing year. <br /> <br />4.41.04 VARIANCES <br /> <br />The Counqil may permit variances from the strict application of any of the provisions of <br />this ordinaf~ce if it is satisfied that there are special circumstances or conditions affecting the <br />premises f~r which the variance is requested and that the granting of such variance will not <br />materially !adversely affect the health, safety or general welfare or public or private <br />property. ~ny variation permitted under this provision must be noted on the permit. A <br />public hearSng is not required. <br /> <br />4.41.05 PENALTIES <br /> <br />An>, person~ violating any provision of this ordinance shall be guilty of a misdemeanor and <br />shall be punished as law provides for such offense. Each day the violation continues shall <br />constitute a separate offense. Any person violating any of the provisions of this ordinance <br />may also b~e liable to the City for any expense, loss or damage occasioned the City by <br />reason of such violation. <br /> <br />SECTION 2: ',SUMMARY <br /> <br />The following official summary of Ordinance iq04-__ has been approved by the City Council of the <br />City of Ramsey as [clearly informing the public of the intent and effect of the Ordinance. <br /> <br />It is the intent and effect of Ordinance g94-__ to add Section 4.41 of the City Code, which <br />Section is ientitled "Street Lighting Utilities". Section 4.41 provides for setting street <br />lighting rates and charges by City Council Resolution. <br /> <br />SECTION 3: ~,EFFECTIVE DATE <br /> <br />The effective date,of this Ordinance is thirty (30) days after its passage and publication, subject to <br />City Charter Secti6n 5.07. <br /> <br /> <br />
