Background: By: 1995 LEGAL SERVICES Ryan Schroeder, City Engineer CASE In late 1991, ithe City requested proposals for general legal and prosecution services from area law fmC. On January 28, 1992, Council awarded a three-year contract to the firm of Randall, _D_eN~ and Goodrich. Within that contract were hourly rates for general legal of $75 for 1992land 1993 and $80 for 1994. Prosecution work was at $60 an hour for 1992, $62 for 1993iand $65 for 1994. We also received "not to exceed" maximum annual costs of $25,000 in~ 1992, $27,050 in 1993 and $29,250 for 1994 billable prosecution time. With expiratign of the above contract on December 31, 1994, we requested a proposal from the existing l~w firm for 1995 through 1997. For general legal, Mr. Goodrich is proposing to retain the kfourly rate at 1994 levels for 1995 and 1996 with an increase to $85 for 1997. There are no bther changes proposed in the general legal area. In the prosecfition area, the current rate is proposed to increase to $67 in 1996 and $69 in 1997, with c ~mplaint preparation increases in these years as well. The not to exceed billings for 995, 1996 and 1997 are proposed to increase to $42,000, $46,200 and $49,500, res ectively. Additionally, cases brought to the State Court of Appeals are proposed to exempted from the billing cap. The attached .etter (and contract) from Mr. Goodrich explains that the City saved $17,000 in the prosec~Ltion area over the last three years due to the billing cap. It is for this reason that he has recuested a significant increase in the caps during the proposed contract period.
