No City officer who is authorized to take part in any manner in making this AgTeement in his or her official capacity shall voluntarily have a personal financial interest in this Agreement or benefit financially therefrom. No member, official, or employee of the City shall be personally liable to Developer, or any successor in interest, in tile event of any default or breach by the City or for any amount which may become due to the Developer or Owner or successor or on any obligations under the terms of this Agreement. Section 11.2 Agreement Recorded. This Agreement shall run with the Development Proper[>, and shall be recorded by the City ii1 tile Office of tile Anoka County Recorder. Section 11.3 Non-Discrimina~.ign. The provisions of Minnesota Statutes, Section 181.59, which relate to civil rights and non-discrimination, and any affirmative action program of the City shall be considered a part of this Agreement and binding on the Developer as though fully set forth herein. Section 11.4 Amendment. This Agreernent may be amended by the parties hereto only by written instrument executed in accordance with tile same procedures and formality followed for the execution of this Agreement. Section 11.5 Counterparts. This Agreement may be executed in an5, number of counterparts, each of which shall constitute one and the same instrument. Section !1.6 Notices and Demands. Except as otherwise expressly provided in this Agreement, a notice, demand or other communication under this Agreement, by either party to the other shall be sufficiently given or delivered if it is sent by.rfiail, postage prepaid, return receipt requested or delivered personally: (a) As to the City: City of Ramsey City Adminis~'ator 15153 Nowthen Boulevard N.W.
