Draft 9/8/94 <br /> <br />Exhibit D <br /> <br /> ASSESSMENT AGREEMENT <br /> AND <br /> CERTIFICATION OF ASSESSOR <br /> <br /> TItlS AGREEMENT, made and entered into this ~ day of , 1994, <br />by and betweenithe CITY OF RAMSEY, MINNESOTA, a Minnesota municipal corporation <br />having its principal office at 15153 Nowthen Boulevard Northwest, Ramsey, Minnesota (City), <br />and Bison Prope~ies, LLC., a Minnesota limited liability corporation having its principal office at <br />9745 - 103rd Avenue North, Maple Grove, Minnesota (Developer): WlTNE~SETIt: <br /> WHERI~AS, the City is administering City Development District No. 1 created pursuant <br />to Minnesota Sta'tutes, Sections 4-69.124 through 469.134; and <br /> WHEREAS, the City is administering Tax Increment Financing District No. 2 created <br />pursu ant to Mi ndesota Statutes, Sections 4-69.174- through 469.179; and <br /> WHEREAS, the parties have entered into a Contract for Private Development <br />CDe'velopmentA~reement), dated , 1994, regarding the development of certain real <br />property located ;in City Development District No. 1 and Tax Increment Financing District No. 2 <br />within the City ~.nd legally described as Lot 1, Block 1, Gateway North Industrial Park Plat 4, <br />Anoka County, 19Iinnesota; and <br /> WHERE~ AS, it is contemplated that pursuant to said Development Agreement, the <br />Developer will c~nstruct the improvements described in such Development A~eement and shall <br />complete them prior to January 1, 1996; and <br /> WHEREAS, the City and the Developer desire to establish minimum market values for <br />said land and the~improvements to be constructed thereon (collectively, the Property), pursuant to <br />Minnesota Statues, Section 469.177, Subdivision 8; and <br /> WltEREAS, the county assessor has reviewed the plans and specifications for the <br />improvements which will be constructed. <br /> <br />NOW <br />1. <br /> <br />THEREFORE, the parties do hereby agree as follows: <br />Ob January 2, 1996, the minimum market value of the Property shall be $500,000. <br />Said minimum market value shall remai'n in effect for the term of this A~eement as <br />d~-scribed in paragraph 4 hereof. <br />Nbthing in this AgTeement sha. ll lin-fit the discretion of the county assessor or any <br />other public official or body having the duty to determine the market value of the <br />Property for ad valorem tax purposes to assign to the Property a market value in <br />e>tcess of the minimum market value specified in this Agreement. <br /> <br />Page 27 <br /> <br /> <br />
