Board Member Deemer introduced thc following resolution and moved for its adoption: <br /> <br />RESOLUTION' #93-09-171 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT g0344 RELATING TO A <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE <br />THAT WILL BE CLOSER TO THE FRONT PROPERTY LINE THAN THE <br />PRINCIPAL STRUCTURE AND THAT WILL ENCROACH ON THE <br />THOROUGHFARE SETBACK ON THE PROPERTY GENERALLY KNOWN <br />15429 SUNFISH LAKE BLVD, N.W. (C.S.A.H. #57) <br /> <br /> WHEREAS, James McChesney, hereinafter referred to as "Applicant", has properly <br />applied for a Board of Adjustment variance from Sections 9.11.01 and 9.11.02 of the Ramsey City <br />Code to construct an accessory structure that will be located closer to the front property line than <br />the principal structure and that will encroach on the Sunfish Lake Blvd. N.W. thoroughfare <br />setback on the property generally 'known as 15429 Sunfish Lake Blvd. N.W. and is leg~ly <br />described as follows: <br /> <br />That part of the Southwest Quarter of the Northwest Quarter of Section 23, Range 32, <br />Township 25 described as follows: Commencing at the northeast comer of said Southwest <br />Quarter of Northwest Quarter, then south on the east line a distance of 510 feet, then west <br />and parallel to the north line of the Southwest Quarter of Northwest Quarter a distance of <br />347 feet to the center of town road, then north 20 degrees east on the centerline of said <br />town road a distance of 544 feet to the north line thereof, then east on the north line of said <br />Southwest Quarter of Northwest Quarter a distance of 165.2 feet to the place of <br />commencement (except that parr platted as Anoka County Highway right-of-way No. 1 <br />recorded 7/16/74). <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />That the AppLicant appeared before the Board of AdjUstment for a public hearing pursuant <br />to Section 9.03.05 of the Ram,ey City Code on September 7, 1993 and that sa.id public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />"Fnat the subject property is zoned R-i Rural Residential and is approximately 2.5 acres in <br />size. <br /> <br />3. That the subject property is surrounded by R-1 Rural Residential zoning. <br /> <br />That Section 9.11.01 of the Ramsey City Code requires a structure setback from <br />thoroughfares of 110 feet from the thoroughfare centerline or 50 feet from the property <br />line, whichever is greater. <br /> <br />That the Applicant is proposing to construct an accessory structure that will be located <br />approximately 92 feet from the centerline of C.S.A.H. #27. <br /> <br />That Section 9.11.02 of the Ramsey City Code prohibits the construction of accessory <br />structures closer to the front property line than the principal structure. <br /> <br />That the principal structure on the subject property is locat'ed approximately 69 feet from the <br />f-rant property line and the proposed location for the accessory structure is approximately <br />48 feet from the front property line, <br /> <br />That the proposed site for the accessory structure was formerly occupied by an above- <br />ground pool with privacy fencing approximately 8 feet high. <br /> <br /> <br />
