Board M~nb~ IJ~m~r <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION g93-09-172 <br /> <br />A RESODUTION APPROVING THE ISSUANCE OF A VARIANCE AND <br /> DECLARING TERMS OF SAME <br /> <br /> WHEREAS, James McChesney has properly applied for a variance to construct an <br />accessory structure that will encroach on the C.S.A.H. #57 (Sunfish Lake Blvd. N.W.) <br />thoroughfare an~ that will be nearer thc front property linc than the principal structure on thc <br />property generalt~ known as 15429 Sunfish Lake Blvd. N.W. and legally described as follows: <br /> <br />That part' of thc Southwest Quarter of the Northwest Quarter of Section 23, Range 32, <br />Township~ 25 described as follows: Commencing at the northeast corner of said Southwest <br />Quarter of Northwest Quarter, then south on the east line a distance of 510 feet, then west <br />and para~.el to thc north line of the Southwest Quarter of Northwest Quarter a distance of <br />347 feet lo the center of town road, then north 20 degrees east on the centerline of said <br />town roa~ a distance of 544 feet to the north line thereof, then east on the north line of said <br />Southwe$ Quarter of Northwest Quarter a distance of 165.2 feet to the place of <br />commenc4:ment (except that part platted as Anoka County H. ighway right-of-way No. 1 <br />recorded '//16/'74). <br /> <br /> WHERE~kS, the Board of Adjustment met on September 7, 1993, conducted the public <br />hearing and ad.6pted findings of fact relating to the request to encroach on the 110 foot <br />thoroughfare setback for C.S.A.H. #57. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT; OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, fas follows: <br /> <br />1. Based on Findings of Pact g0344, a variance to cons~'uct a 25' x 30' accessory, stracmre <br /> that will egcroach on the C.S.A.H. #57 thoroughfare setback and will be nearer the front <br /> property l.i.h~ e than the principal structure is hereby granted. <br /> <br />2. The accessory structure shall maintain a minimum distance of nfl-aery (90) feet from the <br /> centerlineiof C.S.A.I-I. #57. <br /> <br />This variance shall not apply to any future structure(s) placed on the property. <br /> <br /> [ <br />The prope~'ty owner shall provide a survey to determine the south boundary of the subject <br />property t~ alleviate disputed boundaries, and if necessary will be ~m'a_nted a maximum <br />variance o~ 5 feet from the setback requirement on the south property line for the purpose <br />of constructing the accessory structure. <br /> <br />The prop.Crty owner shall obtain ali necessary Perm/ts prior to commencing any <br />consD-LICDOIL <br /> <br />The prope~ owner herein agrees that no commercial activity shall 1~ conducted from the <br />accessory atrucutre. <br /> <br /> <br />
