CASE <br /> <br />REQUEST FOR A VARIANCE FROM SIDE YARD SETBACK REQUIREMENTS <br /> AI~D IMPERVIOUS SURFACE AREA RESTRICTIONS; <br /> CASE OF BILL DUBATS, LAKEVIEW ENTERPRISES, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Bill Dubats of L~keview Enterprises, Inc., has applied for site plan approval to construct self- <br />service storage facilities on Lot 3, Block 3, Riverside West. The subject property is located in the <br />Critical River Overlay District and as such, the impervious surface area is restricted to 30% of the <br />lot area. Mr. Dul:;atS' site plan reflects an impervious surface area of 90%. <br /> <br />In addition, the p~operty is zoned B-3 Highway Business and the side yard setback in this district <br />~s 10 feet. Mr. Dtlbats ~s propomng to develop the site with a zero lot line configuration along the <br />north side yard. <br /> <br />Observations: <br /> <br />This developmen would be an expansion of the self-service storage facilities existing on Lots 1 <br />and 2 of Riversid6 West. In 1987, a variance was granted to the setback requirements in order that <br />the storage fac~hqes to be developed on Lot 1 could be placed w~th a spacing consistent with the <br />structures already constructed on Lot 2. Likewise, Mr. Dubats is proposing to continue the <br />spacing consistency between structures established on Lots 1 and 2 and hence a variance to the side <br />yard setback is necessary along the north property line of Lot 3. <br /> <br />The property is inithe Critical River Overlay Distr/ct and is restricted to a 30% impervious surface <br />area which inch/des structures and pavement. The site plan proposes approximately 90% <br />impervious surfa~ area. The main purpose of the impervious surface area restriction is to prevent <br />pollution of the Mi/ssissippi River from surface water runoff. The original drainage plan submitted <br />by the applicant v~ould have resulted in a runoff discharge of 3.8 cfs in a 2 year storm. Mr. Dubats <br />has worked with the City Engineer to modify the drainage plan to provide for a detention volume <br />consisting of a trehch lined with block that will reduce the surface water discharge into the existing <br />storm water syste,im to 1.7 cfs. <br /> <br />An additional pu~ose of the development restrictions established in the Critical River Overlay <br />District is to mairf~ain a minimum amount of development density in order to preserve the natural <br />aesthetics of the r~ver corr/dor. The subject property is not visible from the fiver. <br /> <br />Mr. Dubats development plan has been forwarded to the Department of Natural Resources, Metro <br />Council and the Environmental Quality Board for review and comment.
