AMENDMENT TO SECTION 9.03.04 TITLED CONDITIONAL USE PERMITS By: Sames D. Gromberg, Economic Development Coordinator Background: ~ The City of Ramsgy has been notified that its procedure when issuing Conditional Use Permits is inconsistent with ~innesota Statutes {}360 requirements, and the rules and regulations that enforce these requirementS. This inconsistency is based upon the City not listing that when a structure is greater than 200 f~t in height it will notify the Minnesota Department of Transportation. The purpose of this ordinance is to bring the City conditional use permit process consistent with State Statutes. T~s change ~s the addmon of the following item to Section 9.03.04, Subdivision 2, and the renumb.~ring of the entire subdivision. e) An~' sponsor who proposes any construction or alteration that would exceed a heil~ht of 200 feet above ground level at the site, or any construction or alteration of greater height than an imaginary surface extending upward and outward at a slope of ~00' to 1' from the nearest point of the nearest runway of a public airport, shall not~fy the MnDOT Commissioner at least 30 days in advance. Public Hearing Notice 2. ; Proposed Ordinance The Planning Comgaission conducted a public hearing on the proposed ordinance at their December 6, 1994 meeting. No verbal or written comments were received. Following the public hearing, the Planning Commission is also recommending adoption of the ordinance. Recommendations: City Staff and Planing Commission recommends that the City Council adopt the proposed Ordinance. , Commission Action: Motion by the Citg Council to approve Ordinance g'94-XX, amending Chapter 9 of the Ramsey City Code (ConditiCnal Use Permits).
