ARTICLE IV <br /> <br />Draft 12/8/94 <br /> <br /> ~ CONSTRUCTION OF SITE IMPROVEMENTS <br /> <br /> Section 4il. Construction of Site Improvements. The City shall construct the extension <br />of the Municipal~Sanitary Sewer and Water services to the Development Property. The cost of <br />these improveme0ts shall be borne by the City with the Developer being responsible for the costs <br />outlined in Exhibit C of this Agreement. The City shall complete the extension of the Municipal <br />Sanitary Sewer a~nd Water services no later than 60 days before the completion of the project. <br />Based upon the s~hedule contained in this document that date is currently April 1, 1996. <br /> <br /> Section 4.:2. Future Site Improvements. The City contemplates constructing an <br />extension of SunC/ood Drive N.W. from County Road #116 west to intersect with 143rd Avenue <br />N.W. at Jaspar S~eet N.W. The Developer shall grant to the City all required easements for the <br />construction of thg Sunwood Drive N.W. extension. Any easements required for the extension of <br />municipal utilitiei shall also be granted to the City without charge upon request by the City. The <br />City, in return fo~those easements, will construct the extension of Sunwood Drive N.W. without <br />assessing any of toe cost to the developer of the Property. <br /> <br /> Section 4.~. .Lien for Site Improvements. The license agreement for the Property shall <br />terminate upon th~ City's completion of the Site Improvements, or on such other date as specified <br />in the document.[The City shall retain a lien on the Property in the amount of $318,234 until <br />completion of the}Minimum Improvements by the Developer, which lien represents the cost to the <br />City of the benefi~ for the construction of the municipal utilities to the property.
