POLICY OF ASSESSMENTS RELATED TO THE STREET MAINTENANCE PROGRAM Preamble Whereas, it is necessary to maintain roadway pavements in a timely manner to achieve the greatest pavement life, and Whereas, the cost of providing timely maintenance is considerable and would place a substantial burden on the City's general fund, if that were the sole funding source, and Wherea~s, well-maintained roadway pavements add to the desirability of a neighborhood and consequently add value to individual properties, and Whereas, the City has had a long standing policy of assessing the cost of street maintenance to benefitted property owners, and Whereas, the method of detem~ining assessments needs to be consistent, well-defined and fair. Now, therefore, the following policy shall determine the basis of assessments for the Street Maintenance Program. Policy A. City Share. The City shall participate 50% of the total project cost after deducting any escrows which may have been contributed by subdivision developers. However, in the case where a previous maintenance project has been defeated by citizen petition, and the proposed maintenance activity is a more costly activity than the one proposed which was defeated by citizen petition, the City shall not contribute said 50% share. B. Projects Aggregated by Subdivision. Since subdivisions typically share similar lot sizes and pavement characteristics throughout the subdivision, each subdivision shall be addressed as an individual project or may be aggregated with subdivisions having similar lot and street characteristics. Where no legal subdivision exists, projects shall consist of aggregated lots in proximity to each other which share common lot and pavement characteristics. C. Project Shares. The cost of each project shall be uniformly distributed among all benefitted buildable parcels within the project area regardless of front footage. Unbuildable outlots and city parks shall not be considered when determining the total number of benefitted shares. Comer lots and double frontage lots. i. Comer lots and double frontage lots which have one or more sides fronting a State Trunk highway, County highway, or City MSA roadway which is not included within the subdivision, shall be assessed a full share. ii. Comer lots which do not fall into category (i) above shall be assessed one half share for each of two frontages. E. MSA roadways and unusual projects On MSA projects, and in certain unusual projects, it is likely that the number of benefitted properties will be unusually small and would result in a highly disproportionate assessment when compared to similar type maintenance projects. In such cases, the City Council may elect to assess each benefitted property the average assessment incurred by all other benefitted properties receiving a similar type maintenance improvement for that year's program.
