Chipped material may be applied and utilized on site to mitigate root damage <br /> t <br /> frorr~,~~ grade changes or used in the right-of-way for erosion control and top soil <br /> rest~ation. <br /> <br /> SECTION VI <br /> GENERAL <br /> <br />Outlots: Th~ DEVELOPER herein agrees tl//~l Outlot A is intended to be utilized for future <br />road right-of~way purposes to provide access to Lots 1 and 2 of Block 1 in the event they are <br />replatted to ~eir ultimate urban densities at some point in the future~ The DEVELOPER <br />agrees to co4vey Outlot A to the CITY ~Pon request. Outlot B is a rerrmant to be replatted <br />into a developable lo't when the'property to the west subdivides and redevelops. <br /> <br />A portion ofithe area north of the plat, currently platted as Outlot C, Wildlife Sanctuary 2nd <br />Addition, sh~ll be included in the plat as an outlot and deeded to the City of Ramsey to <br />protect the w~tlands. <br /> <br />Boulevard ~_~d Area Restoration. The DEVELOPER shall be responsible for the cost of <br />establishing ~eed in all boulevards within thirty (30) days of the completion of the street <br />improvement, and restoring all other areas disturbed by the development grading operation <br />in accordanc~ with the approved erosion and sediment control plan. The DEVELOPER shall <br />also be resp .o~ sible for the cost of cleaning any soil, earth'or debris from the wetlands within <br />and adjacent Bo this Plat resulting from grading performed in the development of the land. <br /> <br />Temporary [Cul-de-Sac Easement. A temporary cul-de-sac shall be constructed at the <br />westerly teri~inus of 155th Lane N.W. and easterly terminus of 154th Lane N.W. An access <br />e~ement is ~}equired-that will expire once these streets extend beyond the boundaries of the <br />Plat. The I~VELOPER shall provide the City a copy of the access easement for review <br />and approvalf The temporary cul-de-sac will be si~,ned as a future through street as a Stage II <br />cost. The D ,EVELOPER herein agrees to deposit a cash escrow with the City in the amount <br />of Four ThoUsand Dollars and no cents ($4,000.00) ($2,000.00 x 2 temporary cul-de-sacs). <br />The purpose~of the escrow is to cover the costs to remove the temporary cul-de-sac when <br />155t" Lane ~.W. is extended as a through street to the west, restore adjacent properties, and <br />extend the si~lewalk to the western boundary of the Plat. <br /> <br />24. <br /> <br />Lot Develo ~p~nent Restrictions. The DEVELOPER herein agrees to establish and record at <br />the office o} the Anoka County Registrar, a covenants restriction that will prohibit the <br />removal of ~y trees, unless they are proven to the City to be dead, dying or diseased, from <br />the west property line of Lots 12, 13 and 14 of Block 3 and Lots 13 through 17 and Outlot B <br />of Block 4, ~s identified on the Final Tree Plan prepared by Passe Engineering, .Inc., and <br />dated Marc~ 27, 2003, revision dated April 17, 2003.
