Case #5: R~quest for a Conditional Use Permit for an Oversized Accessory Building; Chse of David and 'Gall Hennek Community Degelopment Director Frolik stated that the City received an application from Singco Builders, Irepresenting David and Gail Hennek, for a conditional use permit to exceed the accessory building size restrictions established in City Code on the property located at 16100 Wolfram St NWi The proposed building will be t,408 square feet (32' x 44') in size. Coupled with the existing~garage (704 sq. ft.), the applicant would have 2,112 sq. ft. in accessory building space. This resul~ts in an overage of 448 square feet. The applicant would like to exceed the size restriction in or~ler to construct a detached accessory building that would accommodate the . storage of prlvat~ use vehicles and equipment. The Planning Commission conducted a public heanng on Octol~er _, 2003, and there were no verbal or written comments submitted regarding this request. Th~ Plalming Commission recommended the City Council approve the conditional use permit reque~}t. ,, Councihnember {(urak inquired if the legal easement is recorded. David He,reek, h6100 Wolfram Street NW, Ramsey, replied that the easement was recorded in the County of Ar~'oka. Motion by Coun~,ilmember Cook seconded by Councilmember Pearson, to adopt Resolution #03- 10-277 adoptinglFindings of Fact # 0654 relating to David and Gail Hennek's request for a conditional use ~ermit for an oversized accessory building on the property at 16100 Wolfram Street NW. Motion carried, yoting Yes: Mayor Gamec, and Councilmembers Cook, Pearson, Elvig, Kurak, Strmxnnen, and~'Zfimmerman. Voting No: None. Motion by Cour~ilmember Elvig, seconded by Councilmember Kurak, to approve David and Gail Hennek's re~tuest for an oversized accessory building based on the Findings of Fact # 0654 and adopt Resol~ion #03-10-278 declaring terms of same. [. Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Elvig, Kurak, Cook, Pearson, Strommen, and ~immerman. Voting No' None. Case #6: A~opt Ordinance and Resolution Authorizing the Transfer of the Westerly 2~feet of Outlot B Apple Ridge Subdivision to Adjacent Property Owners Assistant Directdr of Public Works Olson stated that in May 2003, the City obtained Outlots B and C of the Apple Ridge Subdivision form US Homes at no cost. The purpose of the property transfer of these !outlots, which were already encumbered with drainage and utility easements, was to allow the ~City to construct a trail adjacent to T.H. #47. The residents adjacent to 'Outlot B expressed conce&s about the trail adversely affecting their privacy since the outlot contains a City Council/October 14, 2003 Page 15 of 30
