Motion by Commi.~sioner Deemer to recommend that City Council approve the preliminary plat of <br />Tooth Acres, as m~dified with outlots, contingent upon City Council entertaining the thought that <br />Outlots B and E, p~chased by Anoka County, be deeded back to the City of Ramsey for park and <br />public use for the ~[ollowing reasons: a) to assure protection of the City of Ramsey's interest in a <br />north/south trail c~rddor and a Mississippi River bridge crossing corridor;, and 2) to satisfy park <br />dedication requirements. <br /> <br />Further DiscussioO: Commissioner Hendriksen reiterated that the proposed subdivision has not <br />been reviewed byithe Park and Recreation Commission and inquired as to why action on the <br />subdivision is so qlrgent. Mr. Banwart replied that the County will not pay Mr. Martin until the <br />plat is recorded; thi[ longer plat approval takes at the City level, the more it is costing Mr. Martin to <br />provide for a MisSissippi River bridge crossing. Commissioner Shumway stated that the plat <br />should not be for yarded to City Council until the Park Commission has reviewed it. Mark <br />Banwart noted tha the southern portion of the property is being condemned; what is of interest to <br />the City is the no: them portion of the property, Outlots A, B and C; 3 lots constitute a minor <br />subdivisions; mint r subdivisions are not required to be reviewed by the Planning Commission or <br />the the Parks Con mission but the City Staff subjects them to those reviews to avoid problems; <br />designation of the lots as A and C means that they cannot be developed; they will surely be <br />resubdivided into [evelopable lots in the future and at that time it would be appropriate to require <br />park dedication. ~'ommissioner Hendriksen requested that the motion be amended to reflect a <br />contingency of an .cceptable park dedication agreement being reached between the City of Ramsey <br />and Anoka County,. <br /> <br />Commissioner De~mer restated his motion as follows: <br /> <br />Motion by CommiSsioner Deemer to recommend that City Council approve the preliminary plat of <br />Tooth Acres, as rrtodffied w~th outlots, connngent upon an acceptable park dedication agreement <br />being reached between the City of Ramsey and Anoka County, which should included entertaining <br />the thought that Outlots B and E, purchased by Anoka County, bedeeded back to the City of <br />Ramsey for park _.a~d public use for the following reasons: a) to assure protection of the City of <br />Ramsey's interest ~n a north/south trail corridor and a Mississippi River bridge crossing corridor; <br />and 2) to satisfy p~k dedication requirements. <br /> <br />Further Discussio.0: Commissioner Hendriksen suggested that a recess be called and that legal <br />advice be sought. ~hairman Zimmerman noted that the r~ording secretary would not be available <br />following a recess,~ Commissioner LaDue stated that in his opinion, this matter is not a major issue <br />and the CommissiOn should vote on the motion and let Anoka County develop it's regional park. <br /> <br />Motion carded. ~oting Yes: Chairman Zimmerman, Commissioners LaDue, Deemer and <br />Shumway.
