Chairman $Simmerman noted that the public is opposed to the PUD concept based on the <br />fact that w~tlands are akeady protected. <br /> <br />Mr. Hartle¥ stated that if the Planning and Zoning COmmission wishes staff to discourage <br />PUDs, the~ the correct procedure would be for the Planning and Zoning Commission to <br />make that ~commendation for a policy change to City Council. <br /> <br />CommissiOner Shumway was opposed to establishing a policy discouraging PUDs because <br />there may [be situations where a PUD is appropriate. <br /> <br />Commissidner Hendriksen stated that he has an ongoing concern with issues that are tabled <br />for lack o~ information and brought back before the Commission without the requested <br />information. <br /> <br />Mr. Hartl~y stated that some of the City's problems in years past were the result of <br />inadequat~or incorrect information; his policy is that nothing is placed on a meeting agenda <br />unless it is~eady to be heard. <br /> <br />Commissi4 ,ner Deemer stated that he was of the understanding that the correct procedure <br />was for St~iff to make recommendations to the Planning Commission and following that, <br />the Staff stiould not have a position. <br /> <br />Mr. Hartle ~ stated that the City Council has asked very specifically that they receive City <br />Staff's rec~ mmendation and most of the time that recommendation is consistents with those <br />of the vari ~us boards and commissions. If Staff's recommendation varies from that of the <br />board or c6mmission, it will not change how City Council views an issue. <br /> <br />Mr. Hartle4/stated that a joint meeting on land use issues is being scheduled for March and <br />that wouldJibe an excellent time to discuss procedures. <br /> <br />NOTE PARK AND RECREATION COMMISSION MEETING MINUTES <br />The ComrOission noted the following: <br /> <br />1. P~k and Recreation Commission regular meeting minutes dated January 11, 1990. <br />COMMISSION BUSINESS <br /> <br />Case #1:[ Request For Conditional Use Permit (CUP) To Establish A <br /> Yard Waste Compost Site; Case Of Waste Management Of <br /> Minnesota, Inc.: <br /> <br />Chairman ~Zimmerman noted that there is a conflict between City Staff and Metro Council <br />staff relating to what constitutes development in a future landfill buffer area. City Attorney <br />Goodrich .has indicated that he has not had a sufficient time frame in which to prepare a <br />legal opin~n regarding this matter and requests that the case be tabled. <br /> ? <br />Mark Ban~art referred to State Statute 473.806 which states that "no development shall be <br />allowed t~ occur within the area of a site or buffer area during the period of the <br />metropolitan development limitation without the approval of the (metro) council.
