Motion b~ Commissioner Hendriksen and seconded by Commissioner Deemer to table <br />action on ~/aste Management's request for a conditional use permit pending a legal opinion <br />from the City Attorney, preparation of proposed findings of fact and conditional use <br />permit, if _~ppropriate. <br /> <br />Further DiScussion: Commissioner Hendriksen stated that he doesn't feel there is a need to <br />rush throullh this case. Mr. Terry Miller stated that he does not have a problem with the <br />motion o~ the floor but there is a need to deal with facts; the facts include that the <br />developm4?t limitation on the subject property was lifted at the time Waste Management <br />was approved for a excavating permit; innuendos of this type being presented to the <br />CommissiOn are time delaying and costly to corporations doing business in Ramsey in <br />addition tff~the amount of citizen time involved. Commissioner Shumway stated that Mark <br />Banwart I/3s the expertise in this particular field and he supports his recommendation <br />100%. 0_40~ mmissioner Hendriksen requested that City Staff research whether the <br />development limitation was lifted for the excavation activity specifically or for all activities. <br /> <br />Motion caffied. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, <br />Shumway hind Deemer. Voting No: None. Absent: Commissioners Bawden and Terry. <br /> <br />Case #2:; Review Establishment Of Information Required On Certificate <br /> ~ Of Survey: <br /> <br />Mark Ban~vart stated that per the Commission's direction on January 2, the proposed <br />certificate~of survey requirements were forwarded to 14 different surveyors for cost <br />estimates ~elating to the cost to provide the proposed information; seven responses were <br />received; t~ose responses indicate that the cost to provide the information would range from <br />$150 to $250 over the cost of a simple survey. <br /> <br />Chairman ~immerman stated that in his opinion, the cost estimates are Iow. Chairman <br />Zimmerm n noted that the 'Elevations' section of the proposed certificate of survey <br />informatiOn may present problems as the City does not have a system of benchmarks <br />establish6:t. Chairman Zimmerman stated that City Council should give some <br />consideratlgn to having a benchmark system established in Ramsey. <br /> <br />Motion by~ Commissioner Shumway and seconded by Commissioner Hendriksen to table <br />informatic/~ pro.posed to be required on certificates of survey to allow the Commission <br />more time ~o review same. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, <br />Deemer a~d Shumway. Voting No: None. Absent: Commissioners Bawden and Terry. <br />Case #3:.; Report On Parliamentary Procedure Workshop: <br /> <br />Commissi!~ner Hendriksen reported the following as information he gained from the <br />parliamenlary procedure workshop held at St. Cloud University: The chairman of the <br />commissid~n is the facilitator of the meeting and part of facilitating a meeting is to keep it <br />moving..l:[arliamentary procedure can be very protracted and it can be used to hinder a full, <br />open disc[t)sure as well as assure a full, open disclosure. The Chairman is to achieve <br />facilitating[ a full open disclosure in a fair way but not necessarily to follow parliamentary <br />procedure~to a fault.
