The Planning Commission and City Council must consider the following criteria when <br />considering a change to the zoning classification of a property: <br />1. Whether the proposed amendment corrects an error or addresses a changing condition, <br />trend or fact. <br />Staff Findings: The land is being subdivided to create a new parcel to be purchased for <br />cemetery purposes. This constitutes a changing condition in the neighborhood that is <br />resulting in the need for a zoning change. <br />2. Whether the proposed amendment will protect the health, safety and welfare of the <br />public. <br />Staff Findings: The amendment is being requested to allow for long term expansion of <br />Calvary Cemetery. Cemetery impacts are physically minimal to the public compared to <br />other potential land uses. As such, the amendment should protect the health, safety, and <br />welfare of the public. <br />3. Whether the City and other service providers will be able to provide sufficient public <br />safety, transportation and utility facilities and services to the subject property, while <br />maintaining sufficient levels of service to existing development. <br />Staff Findings: According to data compiled for the Fiscal Impact Analysis, in 2009 this <br />property had a total of six police calls and zero fire calls. These numbers are minimal <br />and future expansion of the cemetery should not cause a burden on public safety. The <br />additional property will not cause an increase in road maintenance because no new public <br />streets or accesses are being proposed. Water and electrical uses will be minimal and not <br />create a burden on the rest of the community. <br />4. Whether the proposed rezoning will have significant adverse impacts on the natural <br />environment, including air, water, noise, storm water management and vegetation. <br />Staff Findings: The area is currently greenspace and likely would never be developed for <br />parking or building purposes. A cemetery would have almost as minimal impact on the <br />natural environment, including air, water, noise, storm water management and vegetation <br />as open space. <br />S. Whether the proposed amendment will have significant adverse impacts on other <br />property in the vicinity of the subject tract. <br />Staff Finding: The neighboring relationship between the industrial and cemetery use will <br />not change other than where the property line is. Expansion of the cemetery should not <br />impact the industrial use adversely. Properties across Highway 10 should also not be <br />adversely impacted. <br />
