V. Tenant Selection Plan <br />Minnesota Housing requires that a Tenant Selection Plan (Plan) is readily available to anyone interested in such <br />Plan for review and/or retention. Minnesota Housing will not develop or provide such a Plan to owners or <br />management companies. <br />Federal, State and local fair housing laws should be consulted when owners/managers are developing a Plan. It <br />is the responsibility of the owner/manager to have a thorough understanding of the basis under which <br />discrimination is prohibited. <br />A Plan developed for the purpose of objectively selecting potential residents should have a focus on <br />demonstrating an ability to live in harmony with others in a respectful manner. Factors to consider of persons <br />interested in the available housing should include but not be limited to income eligibility, ability to pay the <br />required rent, deposits, and applicable tenant paid utilities; previous rental history; references, expectations of <br />all residents to management, neighbors, visitors to the development, etc. (Also see related items in Chapter 7 B <br />and C, and Chapter 8 G.) <br />W. Other Conditions <br />No member, officer, agent, or employee of Minnesota Housing shall be personally liable concerning any matters <br />arising out of, or in relation to, the allocation and monitoring of Housing Tax Credits. <br />X. Revisions to the Manual and Allocation Plan <br />To the extent necessary to facilitate the award of Housing Tax Credits that would not otherwise be awarded, this <br />Procedural Manual and attached QAP may be modified by Minnesota Housing from time to time. Minnesota <br />Housing may make minor administrative modifications deemed necessary to facilitate the administration of the <br />HTC Program or to address unforeseen circumstances. Further, the Board is authorized to waive any conditions <br />that are not mandated by Section 42 on a case -by -case basis for good cause shown. <br />A written explanation will be made available to the general public for any allocation of a housing credit dollar <br />amount that is not made in accordance with Minnesota Housing's established priorities and selection criteria. <br />The QAP may be amended for substantive issues at any time following public notice and public hearing. Said <br />hearing will be held at the main offices of the Minnesota Housing Finance Agency in St. Paul, Minnesota. Any <br />substantive amendments will require approval of Minnesota Housing Board of Directors and the Governor. <br />To the extent that anything contained in the Manual and QAP does not meet the minimum requirements of <br />federal law or regulations, such law or regulation shall take precedence. <br />15 12012 Housing Tax Credit Procedural Manual Rev. 04/2011 <br />
