NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br /> <br />1.That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />thth <br />to Section 9.03.05 of the Ramsey City Code on March 6, 2008, continued to June 4, <br />2009, continued to July 9, 2009 and that said public hearing was properly advertised. <br /> <br />2.That the Applicant has received a Special Events Permit to operate the model aircraft until <br />such time an interim use permit is approved or denied. <br /> <br />3.That the Subject Property is comprised of five (5) parcels located in the R-1 Residential <br />District and are approximately 128 acres in size together; a portion of the Subject Property <br />is located within the Critical River Overlay District. <br /> <br />4.That Section 9.20.11 (R-1 Residential District) of City Code does not list commercial <br />outdoor recreation as a permitted or conditional use. <br /> <br />5.That the parcels adjacent to the Subject Property to the south and west are part of the <br />Bowers Subdivision; the property to the east of the Subject Property is zoned B-2 Highway <br />Business, and the Subject Property is adjacent to Highway #10 on its northern boundary. <br /> <br />6.That the Subject Property is currently under agricultural use. <br /> <br />7.That the Applicant is only proposing to fly radio-controlled, model aircraft in the northeast <br />quadrant of the Subject Property. <br /> <br />8.That the Applicant is proposing to construct a small runway on an existing path for the <br />agricultural use; the Applicant is proposing to use an existing weed barrier to create the <br />runway that can be easily removed, according to the Applicant. <br /> <br />9.That the Applicant is proposing to establish a parking area southeast of the runway on the <br />west side of the field roadway which leads to the south from the runway area. <br /> <br />10.That the Applicant is proposing to erect several temporary, portable structures including a <br />portable restroom and two sun awnings that can be easily removed at any time, according to <br />the Applicant. <br /> <br />11.That the Applicant has stated that the planes have a range of approximately 600 feet due to <br />line of sight; it appears that there is approximately 2,000 feet from the edge of proposed <br />runway to the nearest developed residential parcel. <br /> <br />12.That the Applicant has stated that they anticipate no more than 10-12 participants at the site <br />at one time. <br /> <br />13.That the City completed a noise study on-site and determined that the noise effects of the <br />Permit would not substantially impact the surrounding parcels. <br />RESOLUTION #09-07-160 <br />Page 2 of 4 <br /> <br />
