<br />Board Member Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #07-08-181 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME. <br /> <br />WHEREAS, <br /> TSM Development, Inc., hereinafter referred to as “Permittee,” has properly <br />applied for a variance from Section 9.20.24 regarding bufferyard requirements and pavement <br />setback requirements in the E-1 Employment District on the property generally located on <br />Ramsey Blvd and Bunker Lake Blvd and legally described as follows: <br /> <br />Portion of Outlot A, Regency Pond, Anoka County, Minnesota, subject to <br />easement of record <br /> <br />and <br /> <br />That part of the Northwest Quarter of the Northwest Quarter of Section 27, <br />Township 32, Range 25, that is described as follows to-wit-commencing at a <br />point on the west line of said section which point is 209 feet north of the <br />southwest corner of said Northwest Quarter of Northwest Quarter as measured <br />along said west line, then proceed east and parallel to the south line of said <br />section for a distance of 209 feet, thence proceed north and parallel to the west <br />line of said section for a distance of 209 feet, then proceed west and parallel to <br />the first course to the west line of said section, then proceed south along the <br />west line of said section point of commencement except road subject to <br />easement of record. <br /> <br />and <br /> <br />That part of the Northwest Quarter of the Northwest Quarter described as <br />follows: Commencing at a point on the west line of said section which point is <br />209 feet north of southwest corner of said Northwest Quarter of Northwest <br />Quarter as measured along said west line, thence proceed east and parallel to the <br />south line of said section for a distance of 209 feet thence proceed south and <br />parallel to west line of said section for a distance of 209 feet, thence proceed <br />west and parallel to first course to the west line of said section thence proceed <br />north along west line of said section to point of commencement, Section 27, <br />Township 32, Range 25, except road subject to easement of record. <br /> <br /> (the “Subject Property”) <br /> <br />WHEREAS <br /> , the Board of Adjustment met on August 2, 2007, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from bufferyard and <br />pavement setback requirements in the E-1 Employment District. <br /> <br />
