<br />Board Member Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #07-09-211 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME. <br /> <br />WHEREAS, <br /> TSM Development, Inc., hereinafter referred to as “Permittee,” has properly <br />applied for a variance from Section 9.50.30 Subd. 3 regarding cul-de-sac size requirements on the <br />property generally located on Ramsey Blvd and Bunker Lake Blvd and legally described as <br />follows: <br /> <br />Outlot A, Regency Pond, Anoka County, Minnesota. <br /> <br /> (the “Subject Property”) <br /> <br />WHEREAS <br /> , the Board of Adjustment met on September 6, 2007, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from cul-de-sac size <br />requirements in City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br /> <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA <br />, as follows <br /> <br /> <br />1.Based on Findings of Fact #0807, a variance is hereby granted to the 60-foot minimum <br />radius and 130-foot right-of-way radius requirements for urban cul-de-sacs, as established <br />in Section 9.50.30 Subd. 3 of City Code, to allow a 55-60 foot pavement radius and a 60- <br />th <br />65 foot right-of-way radius at the terminus of 148 Avenue NW, to be constructed by the <br />th <br />Permittee as part of the plat of Regency Pond 4 Addition. <br /> <br /> <br />2.The Permittee shall construct the cul-de-sac and other improvements per the approved <br />th <br />Site Plan and plat of Regency Pond 4 Addition and to the City’s specifications. <br /> <br /> <br />3.This variance shall automatically expire if it is not initiated within 12 months of the date of <br />issuance. Application for a building permit shall constitute initiation. The Permittee may <br />petition for an extension of time in which to complete the variance. Such extension shall <br />be requested in writing and filed with the City at least 30 days before the expiration of the <br />original variance. <br /> <br /> <br />4.The Permittee agrees that this variance shall be recorded in the office of the Anoka County <br />Recorder. <br /> <br /> <br />5.The Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br /> <br /> <br />
