<br />Councilmember Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-12-422 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT FOR <br />MOTOR VEHICLE SALES WITH OUTDOOR DISPLAY BASED ON FINDINGS OF <br />FACT AND DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, <br />Lumax, LLC (Permittee) has properly applied for a Conditional Use Permit <br />for the sales and outdoor display of vehicles, as permitted as a conditional use under 9.20.22 of <br />City Code for the property legally described as <br /> <br />Lot 10, Auditor’s Subdivision #96, Except Road Subject to Easement of Record, <br />Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br />WHEREAS, <br /> the Planning Commission met on November 3, 2005, conducted the <br />public hearing and recommended City Council denial of the request, and <br /> <br />WHEREAS, <br /> The City Council met on November 22, 2005 and determined that <br />the requested use may be acceptable in the short term and suggested that the Permittee <br />consider an Interim Use Permit, and <br /> <br />WHEREAS <br /> , the Permittee agreed to convert the request for a Conditional Use <br />Permit to an Interim Use Permit. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> <br /> <br />1.Based on Findings of Fact #0750, a Interim Use Permit (Permit) for the sales and outdoor <br />display of vehicles is hereby granted to Lumax, LLC, hereinafter referred to as the <br />“Permittee.” <br /> <br /> <br />2.That the storage area is surfaced with concrete or bituminous. <br /> <br /> <br />3.That this use does not take up parking space or loading area as required for conformity to this <br />chapter. <br /> <br /> <br />4.That this Permit shall be limited to a term of 2 years, renewable at the Planning Commission <br />and Council discretion for an additional two years. <br /> <br /> <br />5.That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Permit. <br /> <br /> <br />
