<br />Councilmember Pearson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-05-136 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT TO <br />PCS BUILDING COMPANY TO ALLOW FOR TEMPORARY CLASSROOM <br />STRUCTURES ON THE SITE OF THE P.A.C.T. CHARTER SCHOOL WITHIN THE <br />RAMSEY TOWN CENTER, BASED ON FINDINGS OF FACT #0675; AND <br />DECLARING THE TERMS OF SAME. <br /> <br />WHEREAS, <br />PCS Building Company, hereinafter referred to as "Applicant", has properly <br />applied to the City of Ramsey (the "City") for an Interim Use Permit to place temporary <br />classroom structures on the site of their future school for an interim period of time on the <br />property generally known as 7250 East Ramsey Parkway and legally described as follows: <br /> <br />Lot 1, Block 1, Ramsey Town Center Addition <br /> <br /> (the "Subject Property") <br /> <br />WHEREAS, t <br /> he Planning Commission met on May 6, 2004, conducted a public hearing <br />and recommended that the City Council approve the request for an Interim Use Permit; and; <br /> <br />WHEREAS, t <br />he City Council met on May 25, 2004 to review the request for an Interim <br />Use Permit to place temporary classroom structures on the site of their future school for an <br />interim period of time. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />This Permit is issued pursuant to Section 9.03.04A of the Ramsey City Code. The conditions of <br />this Permit are as follows: <br /> <br /> <br />1)That the Permittee shall be allowed to place and utilize temporary classrooms on the Subject <br />Property on for a period between August 1, 2004 to October 15, 2004 . <br /> <br /> <br />2)That the Permittee shall adhere to all State Building and Fire Codes regarding the placement <br />and utilization of the temporary classrooms. <br /> <br /> <br />3)That the Permittee shall provide a financial guarantee to the City, guaranteeing the removal of <br />the temporary classrooms and restoration of the site. The financial guarantee shall be in the <br />amount of Ten Thousand Dollars ($10,000.00). The form and issuer of the financial <br />guarantee shall be subject to the approval of the City. The financial guarantee shall be <br />deposited with the City prior to the placement of the temporary structures on the Subject <br />Property. <br /> <br /> <br />4)That not less than 130 parking stalls are available on improved streets surrounding the Subject <br />Property or a combination of improved streets and a temporary parking surface finished with <br />Class 5 materials. No parking will be allowed on Ramsey Blvd. or County Road 116. <br /> <br /> <br />5)That a partial occupancy permit be received from the City’s Building Official for access to the <br /> <br />
