<br />Councilmember Kurak introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-07-195 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO RAMDANCE LLC TO CONSTRUCT A COMMERCIAL CAR WASH IN THE TC-2 <br />ZONING DISTRICT AND DECLARING TERMS OF SAME: <br /> <br /> <br /> WHEREAS, <br /> Ramdance LLC, hereinafter referred to as the “Applicant,” has properly <br />applied for a Conditional Use Permit to construct a commercial car wash in the TC-2 Zoning <br />District on property legally described as follows: <br /> <br />Outlot I, Ramsey Town Center Addition, Anoka County, Minnesota <br /> <br /> (“Subject Property”) <br /> <br />WHEREAS, <br /> the Planning Commission met on July 12, 2004, conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> <br /> <br />1.Based on Findings of Fact #0687, a Conditional Use Permit (Permit) to construct a <br />commercial car wash in the TC-2 Zoning District, is hereby granted to Ramdance, LLC, <br />hereinafter referred to as the “Permittee”. <br /> <br /> <br />2.That the Permit only applies to a commercial car wash constructed as an accessory use to the <br />proposed grocery store that will be located in the future Lot 1, Block 1 of Ramsey Town <br />rd <br />Center 3 Addition. <br /> <br /> <br />3.That the Permit only allows for a 1,777 square-foot commercial car wash to be constructed. <br /> <br /> <br />4.That the commercial car wash shall only be located as shown on the proposed site plan for the <br />grocery store. Any relocation of the car wash shall be reviewed and approved by the City <br />Council. <br /> <br /> <br />5.That the area utilized for the car wash shall be properly constructed and maintained in <br />accordance with all applicable Staff Review letters, approved site plans, City Code, and <br />Uniform Building Codes. <br /> <br /> <br />6.That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br /> <br />7.That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Permit. <br /> <br />
