<br />Councilmember Kurak introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-07-198 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO RAMDANCE LLC TO CONSTRUCT A BUILDING LARGER THAN 35,000 <br />SQUARE FEET IN THE TC-2 ZONING DISTRICT AND DECLARING TERMS OF <br />SAME: <br /> <br /> WHEREAS, <br /> Ramdance LLC, hereinafter referred to as the “Applicant,” has properly <br />applied for a Conditional Use Permit to construct a building larger than 35,000 square feet in the <br />TC-2 Zoning District on property legally described as follows: <br /> <br />Outlot I, Ramsey Town Center Addition, Anoka County, Minnesota <br /> <br /> (“Subject Property”) <br /> <br />WHEREAS, <br /> the Planning Commission met on July 12, 2004, conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> <br /> <br />1.Based on Findings of Fact #0688, a Conditional Use Permit (Permit) to construct a building <br />larger than 35,000 square feet in the TC-2 Zoning District, is hereby granted to Ramdance, <br />LLC, hereinafter referred to as the “Permittee”. <br /> <br /> <br />2.That the Permit only applies to the grocery store to be located in the future Lot 1, Block 1 of <br />rd <br />Ramsey Town Center 3 Addition. <br /> <br /> <br />3.That the Permit only allows for an initial 54,000 square feet of building to be constructed. <br /> <br /> <br />4.That the Permittee is allowed to expand the building to a total of 63,000 square feet after <br />receiving site plan approval for the expansion from the City. <br /> <br /> <br />5.That the grocery store building shall be properly constructed and maintained in accordance <br />with all applicable Staff Review letters, approved site plans, City Code, and Uniform Building <br />Codes. <br /> <br /> <br />6.That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br /> <br />7.That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Permit. <br /> <br /> <br />
