<br />Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-11-346 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME. <br /> <br />WHEREAS, <br /> TSM Development, Inc., hereinafter referred to as “Permittee,” has properly <br />applied for a variance from Section 9.20.24 regarding bufferyard requirements in the E-1 <br />Employment District on the property generally located on Ramsey Blvd and Bunker Lake Blvd <br />and legally described as follows: <br /> <br />Outlot A, Regency Pond, Anoka County, Minnesota <br /> <br /> (the “Subject Property”) <br /> <br />WHEREAS <br /> , the Board of Adjustment met on November 4, 2004, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from bufferyard <br />requirements in the E-1 Employment District. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br /> <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA <br />, as follows <br /> <br /> <br />1.Based on Findings of Fact #0708, a variance is hereby granted to the 60-foot bufferyard <br />requirement, as established in Section 9.20.24 of the Ramsey City Code, to allow a 30- <br />foot bufferyard to be constructed along the northern property line of Outlot A, Regency <br />Pond. <br /> <br /> <br />2.The Permittee shall construct the bufferyard and other improvements per the approved <br />th <br />Site Plan and plat of Regency Pond 4 Addition and to the City’s specifications. <br /> <br /> <br />3.The Permittee shall be responsible for all City costs incurred in processing the variance <br />request. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Shepherd, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Chairperson Nixt <br /> Board Member Shepherd <br /> Board Member Brauer <br /> Board Member Watson <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br />
