That the existing "tuck-under" garage does not count against the allotted square footage for <br /> accessory structures because it is included in the footprint of the house itself. <br /> <br />10. That the additional accessory structure would not exceed the maximum square footage <br /> (1,488) allotted for this parcel. <br /> <br />11. <br /> <br />That there are special conditions applying to the Subject Property that do not generally apply <br />to other properties in the district; namely, the south side yard topography is steeply sloped <br />down to the property line, the rear (east) yard contains the well and a portion of the drain <br />field, and the northeastern portion of the property contains the remainder of the drain field <br />and holding tanks. <br /> <br />12. That the Applicants originally had requested a variance for a seven (7) foot front yard setback <br /> for the accessory structure. <br /> <br />13. <br /> <br />That the Applicants worked with Staffto reconfigure the layout in an attempt to minimize the <br />distance that the accessory structure would sit nearer the front property line than the principal <br />structure. <br /> <br />14. <br /> <br />That staff inspected the site on December 17, 2002, and found that this is the only suitable <br />site for the accessory structure due to the constraints of the property (topography and location <br />of the well and drain field). <br /> <br />15. That the variance requested is the minimum variance that would alleviate the hardship. <br /> <br />16. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br /> property. <br /> <br />17. That if granted, the variance will not unreasonably increase the congestion in the public <br /> street. <br /> <br />18. That if granted, the variance will not increase the danger of fire or endanger the public safety. <br /> <br />19. That the special conditions do not result from the actions of the Applicant. <br /> <br />20.
