Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-02-053 <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT #0642 RELATING TO A REQUEST <br />FROM JANIS DAY FOR A HOME OCCUPATION PERMIT TO ESTABLISH AN IN <br />IIOME HAIR SALON ON THE PROPERTY LOCATED AT 16321 FERRET STREET. <br /> <br /> WHEREAS, the City of Ramsey received an application from Janis Day for a home <br />occupation permit to operate a one-chair hair salon within the dwelling on the property generally <br />known as 16321 Ferret St NW and legally described as follows: <br /> <br />Lot 17, Block 4, Oakridge Estates, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That on January 2, 2003, Janis Day, hereinafter referred to as "Applicant", properly <br />applied for a home occupation permit to establish and operate a hair salon in her home. <br /> <br />That the Applicant appeared before the Ramsey Planning Commission for a public <br />hearing pursuant to Section 9.03.04 of the City Code on February 6, 2003, and that said <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated as a part of these findings by reference. <br /> <br />3. That the Subject Property is zoned R-1 Single Family Residential. <br /> <br />4. That the Subject Property is approximately 2.5 acres in size. <br /> <br />5. That hair salons are not a permitted use in the R-1 Single Family Residential District. <br /> <br />That the Applicant has stated that the home occupation will be conducted within the <br />private dwelling on the property, the area set aside for the home occupation does not <br />exceed 20% of the total floor area of the private dwelling, and the operation will not <br />include any employment of persons not residing in the private dwelling in the <br />performance of the home occupation. <br /> <br />That the Applicant's principal dwelling is serviced by an on-site septic system, therefore <br />Minnesota Pollution Control Agency (MPCA) must approve the in home hair salon due <br />to the chemicals that will be discharged into the septic system. <br /> <br />8. The Applicant has filled out and submitted the required forms to MPCA. <br /> <br /> <br />
