<br />Councilmember Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-10-278 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO DAVID AND GAIL HENNEK FOR AN OVERSIZED ACCESSORY BUILDING <br />BASED ON FINDINGS OF FACT #0654 AND DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, <br />David and Gail Hennek (Permittee) have properly applied for a conditional <br />use permit to exceed the accessory building size restriction for properties located outside the <br />Metropolitan Urban Service Area (MUSA) established in section 9.11.02 “Accessory Uses” of <br />City Code on the property generally known as 16100 Wolfram St NW and legally described as <br />follows: <br /> <br />Lot 1, Block 2, Oakwood Hills, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br />WHEREAS, <br /> the Planning Commission met on October 2, 2003, conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> <br /> <br />1.Based on Findings of Fact #0654, a conditional use permit (Permit) to exceed the accessory <br />building size restriction for properties located outside the MUSA as established in City Code, <br />is hereby granted to David and Gail Hennek, hereinafter referred to as the “Permittee”. <br /> <br /> <br />2.That the overall square footage for accessory buildings may exceed the 1,664 square foot <br />accessory building size restriction for properties located outside the Metropolitan Urban <br />Service Area by a total of 448 feet in order to accommodate the inside storage of private-use <br />equipment and vehicles. <br /> <br /> <br />3.That the construction of the detached accessory building on the Subject Property shall require <br />issuance of a building permit from the City of Ramsey. <br /> <br /> <br />4.That the accessory building shall be properly constructed and maintained in accordance with <br />all applicable Uniform Building Codes. <br /> <br /> <br />5.The Permittee herein agrees that no business use will be operated in the detached accessory <br />building unless such use is permitted in accordance with the City Code. <br /> <br /> <br />6.That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br /> <br />7.That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Permit. <br /> <br /> <br />8.That the City Administrator, or his/her designee, shall have the right to inspect the premises <br />for compliance and safety purposes annually or at any time, upon reasonable request. <br /> <br />
