<br />Councilmember Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-10-284 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO ACADEMIC INVESTMENTS INC. TO CONSTRUCT A SCHOOL LOCATED IN <br />THE TOWN CENTER 3A SUBDISTRICT AND DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, <br /> Academic Investments, Inc., hereinafter referred to as the “Applicant,” has <br />properly applied for a Conditional Use Permit to locate a school in the Town Center 3a Zoning <br />District property legally described as follows: <br /> <br />Lot 1, Block 1, Town Center Addition, Anoka County, Minnesota once the plat is <br />recorded. <br /> <br /> (“Subject Property”) <br /> <br />WHEREAS, <br /> the Planning Commission met on October 2, 2003, conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> <br /> <br />1.Based on Findings of Fact #0656, a Conditional Use Permit (Permit) to construct a school in <br />the TC3a subdistrict, is hereby granted to Academic Investments Inc., hereinafter referred to <br />as the “Permittee”. <br /> <br /> <br />2.That the Applicant is permitted to deviate from the Ramsey Town Center Development <br />Guidelines in the following manner: <br /> <br /> <br />a)Have less than 60% building transparency along Ramsey Blvd. <br /> <br />b)Have less than 40% brick façade along Ramsey Blvd. <br /> <br />c)Have greater setbacks than stated in the Development Guidelines. <br /> <br />d)Have more than 30% of public street devoted to parking along Ramsey Blvd. and Peridot <br />St. <br /> <br /> <br />3.That the School building shall be properly constructed and maintained in accordance with all <br />applicable Staff Review letters, approved site plans, City Code, and Uniform Building Codes. <br /> <br /> <br />4.That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br /> <br />5.That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Permit. <br /> <br /> <br />
