Zoning Bulletin October 25, 2011 I Volume 5 j No. 20 <br />Case Note: The State of Washington legislature has since amended <br />LUPA (under House Bill 2740 in 2010) to clarify that, when a timely <br />motion for reconsideration of a local land use decision is filed, the date <br />of the land use decision triggering the 21 -day time limit for filing a land <br />use petition in superior court is the date the local jurisdiction's decision <br />on a motion for reconsideration is entered. RCW 36.70C.020(2)(c) now <br />includes this provision: <br />Where a local jurisdiction allows or require a motion for recon- <br />sideration to the highest level of authority making the determi- <br />nation, and a timely motion for reconsideration has been filed, <br />the land use decision occurs on the date a decision is entered on <br />the motion for reconsideration, and not the date of the original <br />decision for which the motion for reconsideration was filed. <br />Case Note: Because the Supreme Court held that a motion for recon- <br />sideration filed with a county hearing examiner tolled the finality of the <br />hearing examiner's initial decision, the court found it "unnecessary" for <br />it to consider whether House Bill 2740 applied retroactively. <br />Zoning News from Around the Nation <br />MARYLAND <br />The Baltimore County Council recently adopted regulations for "acces- <br />sory apartments" in single - family homes. "Accessory apartments" are now <br />limited to such apartments for relatives of homeowners and to size stan- <br />dards. Opponents reportedly fear the "bill could potentially allow neigh- <br />borhoods to become much more densely populated than zoning rules now <br />allow." <br />Source: The Baltimore Sun; http://articles.baltimoresun.com <br />} MICI -TE GAN <br />The Huron County Board of Commissioners was recently expected "to <br />vote on a resolution that would impose a moratorium on any new wind <br />overlay districts until the State of Michigan makes a determination regarding <br />the various proposals to eliminate the personal property tax." Under county <br />ordinance, any wind development requires the creation and approval of a <br />wind overlay district.
