Annino, 460 Mass. 790, 2011 WL 5042220 (2011) <br />MASSACHUSETTS (10/26/11)—This case addressed the remedies and <br />timeframe for seeking remedies that are available under Massachusetts <br />statutory law the Zoning Act, G.L. c. 40A to one who is aggrieved by <br />the issuance of a building permit to another person. <br />The B ackground/Facts: Anthony Annino, 7I, trustee of 89-91 Overland <br />Road Realty Trust ("Annino"), planned to demolish and replace an exist- <br />ing two - family structure on his property in Waltham, Massachusetts. An- <br />nino filed applications for two building permits with the city's building de <br />partment. Two days later, on July 30, 2008, Annino's neighbor, Robert E. <br />Connors, Jr. ( "Connors "), learned about them. <br />On August 20, Connors sent a letter to the building commissioner. In <br />that letter, he laid out a legal argument opposing Annino's requested build- <br />ing permits.
